٢٨٥١١ - (حدثنا ابو بكر قال) (١): حدثنا عبد الرحيم بن سليمان عن محمد بن إسحاق عن مكحول (٢).

(٢) مرسل، منقطع حكمًا؛ مكحول تابعي، وابن إسحاق مدلس.
It is narrated from Hazrat Ash'ath that the Holy Prophet (peace and blessings be upon him) decreed one-third of the blood money (diyah) for a wound that reaches the membrane of the brain.

٢٨٥١٢ - وعن اشعث عن الزهري ان النبي ﷺ قضى في الآمة ثلث الدية (١).
ريفرينس و تحكيم الحدیث:
(١) مرسل ضعيف؛ الزهري تابعي، وأشعث ضعيف، ورد الحديث من طريق الزهري عن أبي بكر بن حزم عن أبيه عن جده، وأخرجه أبو داود في المراسيل (٢٥٩)، والنسائي في الكبرى (٧٠٥٨)، وابن حبان (٦٥٥٩)، والحاكم ١/ ٣٩٥، والدارمي (٢٣٦٦)، والبيهقي ٤/ ٨٦، وابن عبد البر في التمهيد ١٧/ ٣٤٠، وابن حزم في المحلى ١٠/ ٤١١.
28512 - From Ash'ath, from Az-Zuhri, that the Prophet صلی اللہ علیہ وسلم ruled that for a female slave, one third of the blood money is due (1).

(٢) حسن؛ عاصم صدوق، أخرجه عبد الرزاق (١٧٣٥٦).
Hazrat Ali (may Allah be pleased with him) said that for a wound that reaches the membrane of the brain, one third of the blood money (diyah) is due.

٢٨٥١٤ - حدثنا ابو بكر قال: حدثنا (محمد) (١) بن فضيل عن اشعث عن الشعبي عن عبد الله قال: في الآمة ثلث الدية [اخماسا (٢).

(٢) ضعيف منقطع؛ الأشعث بن سوار ضعيف، والشعبي لم يسمع من ابن مسعود.
Hazrat Abdullah said that in the case of a wound reaching the membrane of the brain, one third of the blood money will be divided into five parts.

Hazrat Mujahid said that for a wound reaching the membrane of the brain, one third of the blood money (diyah) will be due.

Hasan said that for a wound reaching the membrane of the brain, one third of the blood money is due.

Hazrat Umar bin Abdul Aziz said that if the membrane of the brain is wounded, one third of the blood money (diyah) is due.

Hazrat Dahhak said that for a wound reaching the membrane of the brain, one third of the blood money (diyah) is due.

Hazrat Ata said that in the case of a wound reaching the membrane of the brain, there is one-third (compensation).

٢٨٥٢٠ - حدثنا ابو بكر قال: حدثنا شريك عن ابي إسحاق ان شريحا قضى في الآمة باربعة آلاف.
It is narrated from Hazrat Abu Ishaq that Shurayh gave a verdict of four thousand for a wound that reached the membrane of the brain.
