Ruling If a Slave Kills a Free Person

٢٨٩٥٩ - حدثنا ابو بكر قال: حدثنا حاتم بن إسماعيل عن جعفر عن ابيه عن علي قال: إذا قتل العبد الحر (دفع) (١) إلى اولياء المقتول، فإن شاءوا قتلوه وإن شاءوا استحيوه (٢).

(٢) منقطع؛ أبو جعفر لم يدرك عليًا.
Hazrat Ali (may Allah be pleased with him) said that when a slave kills a free man, he should be handed over to the heirs of the murdered person; if they wish, they may kill him, and if they wish, they may let him live.

٢٨٩٦٠ - حدثنا ابو بكر قال: حدثنا محمد بن ابي عدي عن ابن عون عن محمد قال: لا اعلم الدم إلا لاهله، إن شاءوا باعوا، وإن شاءوا وهبوا، وإن شاءوا استقادوا.
Muhammad said: I consider retribution (qisas) to be only for the heirs of the murdered person; if they wish, they may sell the slave, or if they wish, they may give him as a gift, or if they wish, they may demand retribution from him.

٢٨٩٦١ - حدثنا ابو بكر قال: حدثنا حاتم بن وردان عن يونس عن الحسن في عبد قتل حرا فاعطى ورثته ان يقتلوه، قال: إن (شاؤوا) (١) استرقوه.
ريفرينس و تحكيم الحدیث:
(١) في [ط، هـ]: (شاء).
It is narrated from Hasan regarding a slave that if someone kills a free man and then he (the killer) is handed over to the heirs of the murdered person so that the heirs may kill him, he (Hasan) said: If they wish, they may make him a slave.

٢٨٩٦٢ - حدثنا ابو بكر قال: حدثنا الضحاك بن مخلد عن ابن جريج عن عطاء قال: يدع إلى اولياء المقتول، فإن شاءوا قتلوا، وإن (شاؤوا) (١) استرقوا.
ريفرينس و تحكيم الحدیث:

Hazrat Ata said that the slave should be handed over to the heirs of the murdered person; then if they wish, they may kill him, and if they wish, they may keep him as a slave.

٢٨٩٦٣ - حدثنا ابو بكر قال: حدثنا وكيع عن سفيان عن جابر عن عامر.
Hazrat Ibn Jurayj and Ata say that if the heirs of the murdered person wish, they may kill him, and if they wish, they may make him a slave.

٢٨٩٦٥ - حدثنا ابو بكر قال: حدثنا عبد الرحيم بن سليمان عن محمد بن سالم عن الشعبي في عبد قتل حرا متعمدا قال: (يعطى) (١) هؤلاء اهل المقتول، إن شاءوا قتلوه، وإن شاءوا استرقوه.

It is narrated from Hazrat Sha'bi regarding a slave that if someone intentionally kills a free person, then this slave should be handed over to the heirs of the murdered person; if they wish, they may kill him, and if they wish, they may make him a slave.

٢٨٩٦٦ - حدثنا ابو بكر قال: حدثنا عباد عن عمر بن عامر عن حماد عن إبراهيم في العبد يقتل الحر عمدا قال: ليس لهم ان يستخدموه، إنما لهم دمه، إن شاءوا قتلوه، وإن شاءوا عفوا عنه.
It is narrated from Ibrahim regarding a slave who intentionally kills a free man, that it is not permissible for the heirs to take service from him. They only have the option that if they wish, they may kill him, and if they wish, they may pardon him.
