من قال: لا يبلغ به دية الحر
Those Who Hold That Blood Money for a Free Person Is Not Taken from a Slave

٢٨٩٨٠ - حدثنا ابو بكر قال: حدثنا عبد الاعلى عن داود عن الشعبي ان سعيد ابن (العاص) (١) جعل دية عبد قتل خطا اربعة آلاف، وكان ثمنه اكثر من ذلك، وقال: اكره ان اجعل ديته اكثر من دية الحر (٢).
ريفرينس و تحكيم الحدیث:

(٢) صحيح.
It is narrated from Hazrat Sha'bi that Sa'id bin As fixed the blood money (diyah) for a slave who was killed by mistake at four thousand "4000", even though his value was more than that, and he said: "I do not like to fix his diyah higher than the diyah of a free man."

٢٨٩٨١ - حدثنا ابو بكر قال: حدثنا ازهر عن ابن عون عن إبراهيم قال: لا يبلغ به دية الحر.
Ibrahim said that its blood money will not be made equal to that of a free person.

٢٨٩٨٢ - حدثنا ابو بكر قال: حدثنا محمد بن بكر عن ابن جريج عن عطاء قال: لا يزاد (السيد) (١) (على) (٢) دية الحر.

It is narrated from Hazrat Ata that more than the blood money of a free man should not be taken from the owner.

٢٨٩٨٣ - حدثنا ابو بكر قال: حدثنا وكيع عن سفيان عن مغيرة عن إبراهيم والشعبي قالا: لا يبلغ (بدية) (١) العبد دية الحر في الخطا.

Ibrahim and Shabi have stated that in the case of accidental killing, the blood money for a slave will not be considered equal to that of a free person.

٢٨٩٨٤ - حدثنا ابو بكر قال: حدثنا غندر عن شعبة عن الحكم عن إبراهيم قال: دية المملوك انقص من دية الحر.
It is narrated from Ibrahim that the blood money of a slave is less than the blood money of a free person.
