Blood Money for the Child in the Womb of a Female Slave

٢٩٠٢٧ - حدثنا ابو بكر قال: حدثنا إسماعيل بن علية عن عبد الرحمن بن إسحاق عن الزهري عن سعيد بن المسيب قال: جنين الامة عشرة دنانير.
Hazrat Saeed ibn al-Musayyib said that for causing the miscarriage of a slave woman's fetus (that is, the child who is still in the womb), the compensation is ten dinars.

Hazrat Hammad says that there is a ruling regarding the child present in the womb of the slave woman.

٢٩٠٢٩ - حدثنا ابو بكر قال: حدثنا محمد بن ابي عدي عن اشعث عن الحسن قال: جنين الامة إذا (استهل) (١) فقيمته يوم (استهل) (٢).

Hasan says that when a child cries at the time of birth, the account will be taken for the value of the day on which he cried.

٢٩٠٣٠ - حدثنا ابو بكر قال: حدثنا يزيد بن هارون عن اشعث عن الحكم قال: كانوا ياخذون جنين الامة من جنين الحرة.
Hazrat Hakam said that people used to consider the child of a slave woman as having the same ruling as the child of a free woman.

٢٩٠٣١ - حدثنا ابو بكر قال: حدثنا حفص عن اشعث عن الحكم وحماد عن إبراهيم انه قال: في جنين الامة من ثمنها كنحو من جنين الحرة من ديتها: العشر ونصف العشر.
Ibrahim said that the value of the child in the womb of a slave woman is based on the price of the slave woman, and the value of the child of a free woman is based on her blood money, that is, one-tenth and half of one-tenth.

٢٩٠٣٢ - حدثنا ابو بكر قال: حدثنا محمد بن يزيد عن ابي العلاء عن قتادة قال: إن وقع حيا فعليه ثمنه، وإن وقع ميتا فعليه (عشر) (١) (ثمن) (٢) (امه) (٣).

Hazrat Qatadah says that if a child is born alive, then its full value is applicable, and if it is born dead, then one-tenth of its mother's value is applicable.

٢٩٠٣٣ - حدثنا ابو بكر قال: حدثنا عبد الاعلى عن يونس عن الحسن في جنين الامة عشر ثمنها.
It is narrated from Hasan that the child in the womb of a slave woman is valued at one-tenth of the price of its mother.

٢٩٠٣٤ - حدثنا ابو بكر قال: حدثنا ابو اسامة عن هشام عن الحسن قال: عشر ثمنها.
It is narrated from Hasan that its price is one-tenth of its mother.

٢٩٠٣٥ - حدثنا ابو بكر قال: سمعت وكيعا يقول قال: سفيان ونحن (نقول) (١): إن كان غلاما فنصف عشر قيمته، وإن كانت جارية فعشر قيمتها، لو كانت حية.

Hazrat Sufyan says that we say: if the fetus is a male slave (i.e., a boy is born), then one twentieth of his price must be given, and if it is a female slave (i.e., a girl is born), then one tenth of her price must be given.
