Hazrat Mak'hool narrates that when Hazrat Umar came to us at Bayt al-Maqdis, Hazrat Ubadah bin Samit gave his mount to a dhimmi person so that he might hold it, but he refused. So he (Ubadah) inflicted a deep wound on him, then entered the mosque. When Hazrat Umar heard the sound of a scream, he said: Who has caused him pain? Hazrat Ubadah said: I am the one sought for this. He (Umar) asked: What did you do to him? He replied: I gave him my mount to hold, but he refused, and I am a man upon whom the hadd (legal punishment) has become incumbent. He (Umar) said: It is not so; rather, sit for qisas (retaliation). Upon this, Hazrat Zayd bin Thabit said to him: No, you cannot exact qisas from your brother for your slave. He (Umar) said: By Allah! If I forgo your qisas, I will surely put you to hardship regarding the blood money; you must pay him his blood money twice.

Hazrat Ibn Abi Dhi'b states that Hazrat Zuhri said: There will be no qisas (retaliation) between a Christian and a free Muslim, and between a slave and a Muslim.
