Regarding the Slanderer: Are His Clothes Removed or Is He Flogged in Them?

٣٠١٩٨ - حدثنا ابو بكر قال: حدثنا ابن فضيل عن ابن شبرمة قال: كنت عند الشعبي فاتي برجل قد اخذ في حد او قذف، فضربه الحد وعليه قميص ما ادري ما تحته.
Hazrat Ibn Shurmah narrates that I was with Imam Sha’bi when a man was brought who had been caught in a matter of hadd (prescribed punishment) or accusation. So he (Imam Sha’bi) carried out the hadd on him while he was wearing a shirt on his body; I do not know what was underneath it.

Hazrat Mujahid and Ibrahim stated: The one who falsely accuses should be beaten while he is clothed.

30200 - From al-Mughira, from Ibrahim, they said: The slanderer is flogged while he is wearing his clothes.

٣٠٢٠١ - حدثنا ابو بكر قال: حدثنا ابن علية عن إسماعيل بن امية عن سعد بن إبراهيم عن ابيه قال: إني لاذكر (مسك) (١) شاة امرت بها (امي) (٢) فذبحت حين ضرب عمر ابا (٣) بكرة فجعل مسكها على ظهره من شدة الضرب (٤).

(٢) سقط من: [أ، ط، هـ].
(٣) في [أ، ب، ط]: زيادة (أبي).
(٤) منقطع؛ إبراهيم بن عبد الرحمن لم يدرك عمر.
Hazrat Saad bin Ibrahim narrates that his father Ibrahim said: Surely, I will mention the skin of the goat about which my mother ordered, so it was slaughtered. When Hazrat Umar flogged Hazrat Abu Bakrah, he placed its skin on his back due to the severity of the beating.

٣٠٢٠٢ - حدثنا ابو بكر قال: حدثنا اسباط بن محمد عن مطرف عن الشعبي قال: يضرب القاذف وعليه ثيابه إلا ان يكون عليه فرو او (قباء) (١) محشو حتى يجد مس الضرب.

Hazrat Mutarrif narrates that Hazrat Sha'bi said: The one who falsely accuses should be flogged while he is wearing clothes, except that it should not be a fur-lined garment or a cloak filled with cotton, so that he feels the severity of the lashes.

٣٠٢٠٣ - حدثنا ابو بكر قال: حدثنا ابو معاوية عن الحجاج عن الوليد (بن) (١) ابي مالك ان ابا عبيدة بن الجراح اتي برجل (في حد) (٢) فذهب الرجل ينزع قميصه وقال: ما ينبغي لجسدي هذا المذنب ان يضرب وعليه القميص، قال: فقال ابو عبيدة: لا تدعوه ينزع قميصه، فضربه عليه (٣).

Hazrat Waleed bin Abu Malik narrates that a man was brought to Hazrat Abu Ubaidah bin Jarrah regarding a punishment. The man began to take off his shirt himself and said: "It is not appropriate for this sinful body of mine to be beaten while wearing a shirt." Hazrat Abu Ubaidah said: "Do not let him take off his shirt." Thus, he was flogged while he was still wearing his shirt.

٣٠٢٠٤ - حدثنا ابو بكر قال: حدثنا غندر عن شعبة عن حماد قال: يضرب القاذف وعليه ثيابه.
Hazrat Sha’bah narrates that Hazrat Hammad said: The one who falsely accuses should be beaten while he is wearing clothes.

٣٠٢٠٥ - حدثنا ابو بكر قال: حدثنا عبد الرحيم عن إسماعيل عن الحسن قال: إذا قذف الرجل في الشتاء لم يلبس ثياب (الصيف) (١)، ولكن يضرب في ثيابه التي قذف فيها، (و) (٢) إذا قذف في الصيف لم يلبس ثياب الشتاء، يضرب فيما قذف فيه.

Ismail narrates that Hasan Basri said: When a man accuses someone during winter, he will not be made to wear summer clothes, but he will be flogged in the same clothes in which he made the accusation. And when he accuses someone during summer, he will not be made to wear winter clothes; he will be flogged in the same clothes in which he made the accusation.

٣٠٢٠٦ - حدثنا ابو بكر قال: حدثنا غندر عن شعبة عن (سعد) (١) بن إبراهيم عن ابيه عن امه قالت: إني لاذكر مسك شاة -ثم ذكر نحوا من حديث ابن علية (٢).

(٢) مجهول؛ أم إبراهيم مجهولة، وحديث ابن علية تقدم برقم [٣٠٢٠١].
Ibrahim narrates that his mother said: Indeed, I will certainly mention the goat's skin. Then she related the same subject as mentioned in the previous hadith of Ibn ‘Ulayyah.
