Regarding Establishing Hudud and Retaliation in the Haram

٣٠٨٤٤ - حدثنا ابو بكر قال: حدثنا عبد الله بن إدريس عن مطرف عن عامر قال: إذا هرب إلى الحرم فقد امن فإن اصابه في الحرم اقيم عليه الحد في الحرم.
Hazrat Mutarrif narrates that Hazrat Aamir said: When he fled towards the Haram, indeed he attained safety. Thus, if he committed any punishable act within the Haram, then the prescribed punishment will be carried out upon him within the Haram.

٣٠٨٤٥ - حدثنا ابو بكر قال: حدثنا ابن إدريس عن ليث عن عطاء ان الوليد (١) اراد ان يقيم على رجل الحد في الحرم، فقال له عبيد بن عمير: لا تقمه إلا ان يكون اصابه فيه.

Hazrat Ata says that Hazrat Walid intended to enforce the hadd punishment on a man in the Haram, so Hazrat Ubaid bin Umair said to him: Do not enforce the hadd punishment on him unless he committed the punishable act within the Haram itself.

٣٠٨٤٦ - حدثنا ابو بكر قال: حدثنا عبد الله بن إدريس عن هشام عن الحسن وعطاء (قالا) (١): إذا اصاب حدا في غير الحرم، ثم (لجا) (٢) إلى الحرم، اخرج من الحرم حتى يقام عليه.

Hazrat Hisham states that Hasan Basri and Hazrat Ata said: When someone becomes liable for a hadd punishment outside the Haram and then seeks refuge in the Haram, he will be taken out of the Haram until the hadd punishment is carried out on him.

٣٠٨٤٧ - حدثنا ابو بكر قال: حدثنا ابو الاحوص عن خصيف عن مجاهد قال: إذا اصاب الرجل الحد في غير الحرم ثم اتى الحرم، اخرج من الحرم، (فاقيم) (١) عليه الحد، وإذا اصابه في الحرم اقيم عليه في الحرم.

Hazrat Khaseef narrates that Hazrat Mujahid said: When a person becomes liable for hadd (punishment) outside the Haram and then enters the Haram, he will be taken out of the Haram and then the hadd will be carried out on him. And when he becomes liable for hadd within the Haram, then the hadd will be carried out on him within the Haram.

٣٠٨٤٨ - حدثنا ابو بكر قال: حدثنا عبد السلام بن حرب عن خصيف عن مجاهد ان رجلا قتل رجلا ثم دخل الحرم، قال: يؤخذ فيخرج به من الحرم، ثم يقام عليه الحد (١)، يقول: القتل.

Hazrat Khaseef narrates that it is reported from Hazrat Mujahid that a man killed another man and then entered the Haram. He said: He will be seized and taken out of the Haram, then the prescribed punishment will be carried out upon him. He said: He will be killed.

٣٠٨٤٩ - حدثنا ابو بكر قال: حدثنا عبد السلام عن عطاء (١) عن سعيد وعبد الملك عن عطاء في الرجل يقتل ثم يدخل الحرم، قال: لا تبايعه اهل مكة ولا يشترون منه ولا يسقونه ولا يطعمونه ولا يؤوونه، ولا ينكحونه حتى يخرج فيؤخذ به.

(١) في [هـ]: زيادة (بن السائب).
It is narrated from Hazrat Saeed and Hazrat Ata regarding a person who commits murder and then enters the Haram, they said: The people of Makkah should neither buy nor sell with him, nor give him water, nor feed him, nor give him shelter, nor marry him. Until he leaves, then he will be apprehended.

٣٠٨٥٠ - حدثنا ابو بكر قال: حدثنا (ابو) (١) معاوية عن حجاج عن عطاء عن ابن عمر وابن عباس قالا: لو وجدنا قاتل آبائنا في الحرم لم نقتله (٢).

(٢) منقطع حكمًا؛ حجاج مدلس.
Hazrat Ata states that Hazrat Ibn Umar (may Allah be pleased with them both) and Hazrat Ibn Abbas (may Allah be pleased with them both) said: If we were to find the killer of our forefathers even in the Haram, we would not kill him.

٣٠٨٥١ - حدثنا ابو بكر قال: حدثنا وكيع عن شعبة قال: سالت الحكم وحمادا عن الرجل يقتل ثم يدخل الحرم، قال حماد: يخرج فيقام (عليه) (١) الحد.

Hazrat Sha’bah narrates that I asked Hazrat Hakam and Hazrat Hammad about the person who commits murder and then enters the Haram; what is the ruling regarding him? Hazrat Hammad said: He will be taken out and then the prescribed punishment will be carried out on him. Hazrat Hakam said: No buying or selling will be done with him, and he will not be given food.
