Regarding Paternal Cousins, One of Whom Is Also a Maternal Brother

٣٣١٥٣ - حدثنا جرير عن مغيرة عن الشعبي قال: كان علي وزيد يقولان في بني عم احدهم اخ لام: يعطيانه السدس، وما بقي بينه وبين بني عمه، وكان عبد الله يعطيه المال كله (١).
ريفرينس و تحكيم الحدیث:
(١) صحيح.
Shu'bi narrates that Hazrat Ali (may Allah be pleased with him) and Hazrat Zaid (may Allah be pleased with him) used to say regarding those paternal cousins, among whom one is a maternal brother, that he should be given one-sixth share, and the remainder should be divided between him and the other paternal cousins. And Hazrat Abdullah (may Allah be pleased with him) used to give the entire wealth to that paternal cousin.

٣٣١٥٤ - حدثنا وكيع عن سفيان عن ابي إسحاق عن الحارث عن علي قال: اتي في بني عم احدهم اخ لام، وكان ابن (مسعود) (١) اعطاه المال كله، فقال علي: يرحم الله ابا عبد الرحمن إنه كان لفقيه، لو كنت لاعطيه السدس، وكان شريكهم (٢).
ريفرينس و تحكيم الحدیث:
(١) في النسخ (عباس)، وتصويبه من قوله (أبا عبد الرحمن)، وهكذا أخرجه البيهقي ٦/ ٢٤٠، والدارمي (٢٨٨٩)، وسعيد بن منصور ١/ (١٢٨)، والطبراني (٨٤٧٩)، وابن عساكر ٣٣/ ١٥١، وعبد الرزاق (١٩١٣٣).
(٢) ضعيف؛ لضعف الحارث.
Harith narrates that a case was brought before Hazrat Ali (may Allah be pleased with him) regarding paternal cousins, one of whom was a maternal brother, while Hazrat Ibn Mas’ud (may Allah be pleased with him) had given the entire inheritance to the maternal brother. Hazrat Ali (may Allah be pleased with him) said: May Allah have mercy on Abu Abdur Rahman, he was indeed a jurist. If it were up to me, I would have given him one-sixth, and then he would have shared the remainder of the wealth with the other paternal cousins.

٣٣١٥٥ - حدثنا وكيع عن سفيان عن خالد الحذاء عن ابن سيرين عن شريح انه كان يقضي في بني عم احدهم اخ لام بقضاء عبد الله (١).

(١) صحيح.
Muhammad bin Sirin narrates that Hazrat Shurayh used to judge regarding those paternal cousins, among whom one was a maternal brother, according to the decision of Hazrat Abdullah (may Allah be pleased with him).

٣٣١٥٦ - حدثنا ابن فضيل عن بسام عن فضيل عن إبراهيم في امراة تركت بني عمها احدهم اخوها لامها، قال: فقضى فيها عمر وعلي وزيد؛ ان لاخيها من امها السدس، وهو شريكهم بعد في المال، وقضى فيها عبد الله ان المال له دون بني عمه (١).
ريفرينس و تحكيم الحدیث:
(١) منقطع؛ إبراهيم لم يدرك هؤلاء الصحابة.
Ibrahim states that when a woman died leaving behind paternal cousins, among whom one was her maternal brother, regarding this, Hazrat Umar, Hazrat Ali (may Allah be pleased with them), and Hazrat Zaid (may Allah be pleased with him) gave the verdict that her maternal brother will receive one-sixth, and then he will share in the remainder of the wealth with the others. And regarding this, Hazrat Abdullah (may Allah be pleased with him) gave the verdict that the wealth will go only to him, not to the other paternal cousins of the deceased. Abu Bakr states that this issue, according to the opinion of Hazrat Umar, Hazrat Ali, and Hazrat Zaid (may Allah be pleased with them), will be resolved from six shares, and according to the opinion of Hazrat Abdullah and Shurayh (may Allah be pleased with them), it will be resolved from one share, and that will be the entire wealth.

٣٣١٥٧ - قال ابو بكر: فهي في قول عمر وعلي وزيد من ستة اسهم، وهي في قول عبد الله وشريح من سهم واحد وهو جميع المال.
33157 - Abu Bakr said: Thus, according to the statement of Umar, Ali, and Zayd, it is from six shares, and according to the statement of Abdullah and Shurayh, it is from one share, which is the entire wealth.
