Regarding Those Who Do Not Allow the Grandmother to Inherit While Her Son Is Alive

٣٣٤٣٦ - حدثنا عبد الاعلى عن سعيد عن قتادة عن سعيد بن المسيب عن زيد ابن ثابت قال، (منعها) (١) ابنها الميراث (٢).
ريفرينس و تحكيم الحدیث:
(١) في [أ، ب]: (منع).
(٢) صحيح؛ رواية عبد الأعلى عن سعيد قبل اختلاطه.
Saeed bin Musayyib narrates from Hazrat Zaid bin Thabit (may Allah be pleased with him) that he said: The son prevents the grandmother from inheritance.

٣٣٤٣٧ - حدثنا عبد الاعلى عن معمر عن الزهري ان عثمان كان لا يورث الجدة ام الاب وابنها حي (١).
ريفرينس و تحكيم الحدیث:
(١) منقطع، الزهري لم يسمع من عثمان.
Zuhri says that Hazrat Uthman (may Allah be pleased with him) would not make the grandmother an heir while her son was alive. Zuhri states that when the son of Hazrat Zubair (may Allah be pleased with him) passed away, he (Hazrat Uthman) did not make (his grandmother) an heir.

٣٣٤٣٨ - قال الزهري: وتوفي ابن الزبير (فلم) (١) (تورث) (٢) (٣).

(٣) منقطع؛ الزهري لم يسمع من عثمان.
33438 - Al-Zuhri said: And Ibn al-Zubayr died (but) (he was not) (inherited from) (3).

٣٣٤٣٩ - حدثنا ابن فضيل عن بسام عن فضيل قال: قال إبراهيم: لا (ترث) (١) الجدة مع ابنها إذا كان حيا في قول علي وزيد (٢).

(١) في [أ، ط، هـ]: (تورث).
(٢) منقطع؛ إبراهيم لم يدرك عليًا وزيدًا.
Ibrahim states that according to the command of Ali (may Allah be pleased with him) and Zaid (may Allah be pleased with him), a grandmother does not inherit while her son is alive. Abu Bakr states that he heard Waki’ say that the scholars of hadith are unanimous on this.

٣٣٤٤٠ - قال ابو بكر: سمعت وكيعا يقول الناس على هذا.
33440 - Abu Bakr said: I heard Waki‘ say, "The people are upon this."

٣٣٤٤١ - حدثنا وكيع عن إسرائيل عن جابر عن عامر قال: لم يورث احد من اصحاب النبي ﷺ الجدة مع ابنها إلا ابن مسعود (١).

(١) ضعيف؛ لضعف جابر الجعفي.
Hazrat Aamir says that among the companions of the Holy Prophet (peace and blessings be upon him), no one except Hazrat Ibn Masood (may Allah be pleased with him) considered the grandmother an heir while her son was alive.

٣٣٤٤٢ - حدثنا يزيد بن هارون عن ابن ابي عروبة عن قتادة عن سعيد بن المسيب ان زيدا لم (يكن) (١) يجعل للجدة مع ابنها ميراثا (٢).
ريفرينس و تحكيم الحدیث:
(١) سقط من: [ط، هـ].
(٢) صحيح.
Hazrat Saeed bin Musayyib states that Hazrat Zaid (may Allah be pleased with him) would not grant inheritance to the grandmother when her son was alive.

٣٣٤٤٣ - حدثنا يزيد عن محمد بن سالم عن الشعبي عن علي وزيد انهما لم يكونا يجعلان للجدة مع ابنها ميراثا (١).
ريفرينس و تحكيم الحدیث:
(١) ضعيف جدًا؛ محمد بن سالم متروك.
Shu'bi narrates that Hazrat Ali (may Allah be pleased with him) and Hazrat Zaid (may Allah be pleased with him) would not make the grandmother an heir while her son was alive.
