٣٣٦٤٣ - حدثنا عبد السلام عن الاعمش عن إبراهيم عن علي وعمر وزيد انهم كانوا لا يورثون النساء من الولاء إلا ما اعتقن (١).
ريفرينس و تحكيم الحدیث:
(١) منقطع؛ إبراهيم لم يدركهم.
Ibrahim narrates from Hazrat Ali, Umar, and Zaid (may Allah be pleased with them) that they used to make only that woman the heir of her wala’ whom she had set free.

٣٣٦٤٤ - حدثنا عباد عن هشام عن ابن سيرين قال: (لا ترث) (١) النساء من الولاء إلا [ما اعتقن او كاتبن.

Ibn Sirin says that women inherit the right of wala only from those whom they set free.

٣٣٦٤٥ - حدثنا حفص عن اشعث عن جهم عن إبراهيم قال: لا يرث النساء من الولاء] (١) إلا ما كاتبن او اعتق من اعتقن.

(١) سقط ما بين المعكوفين من: [أ، ب، جـ، هـ].
Ibrahim says that women inherit the right of allegiance only from those whom they make mukatab (contracted slaves) or whom they set free, or from those freed by their freed ones.

٣٣٦٤٦ - (١) حدثنا معاذ عن اشعث عن الحسن انه قال: لا (ترث) (٢) النساء من الولاء إلا ما اعتقن او اعتق من اعتقن، إلا الملاعنة فإنها ترث (٣) ابنها الذي انتفى منه ابوه.
ريفرينس و تحكيم الحدیث:
(١) زيادة في [جـ]: (حدثنا حفص).
(٢) في [م]: (يرث).
(٣) زيادة في [هـ]: (من أعتق).
Hasan says that women inherit the wala only of the one whom they set free, or of the one whom their freed slave sets free, except for the woman involved in li'an, for she inherits from the one whose lineage her father denies.

٣٣٦٤٧ - حدثنا وكيع عن سفيان عن ابن جريج عن رجل عن عمر بن عبد العزيز قال: لا (ترث) (١) النساء من الولاء إلا ما كاتبن او اعتقن.

Umar bin Abdul Aziz says that women inherit the right of wala only from those whom they make mukatab or set free.

٣٣٦٤٨ - [حدثنا ابن ابي غنية عن عبد الملك عن عطاء قال: لا يرث النساء من الولاء شيئا إلا ما كاتبن او اعتقن] (١).
ريفرينس و تحكيم الحدیث:
(١) سقط الخبر من: [أ، ب، جـ، هـ].
Ata says that women do not inherit anything from wala except for those whom they make mukatab or set free.

٣٣٦٤٩ - حدثنا ابن علية عن خالد عن ابي قلابة في امراة توفيت وتركت مولاها، قال: هو مولاها إذا مات يرثه من يرثها من الذكور.
Khalid narrates from Abu Qilabah about the woman who died and left her mawla; he said that he is her mawla, and when he dies, his heir will be every man among those who would have been the heir of that woman.

٣٣٦٥٠ - حدثنا عمر بن هارون عن يونس عن الزهري عن سعيد بن المسيب قال: لا (ترث) (١) النساء من الولاء إلا ما اعتقن او كاتبن.

Saeed bin Musayyib says that women inherit only that wala’ (right of inheritance) from those whom they set free or make mukatab (contracted for freedom).

٣٣٦٥١ - حدثنا غندر عن شعبة عن مغيرة عن إبراهيم قال: لا (ترث) (١) النساء من الولاء إلا ما اعتقن.

Ibrahim, through another chain of narration, states that women inherit only the wala’ of those whom they set free.

٣٣٦٥٢ - حدثنا وكيع قال: ثنا سفيان عن منصور عن إبراهيم قال في الرجل (يكاتب) (١) عبده ثم يموت ويدع ولدا: رجالا ونساء؟ قال: المال بينهم بالحصص، والولاء للرجال دون النساء.

Ibrahim says about the man who makes his slave a mukatab and then dies, leaving behind male and female children, that the wealth will be divided among them according to their shares, and the wala’ will be for the men, not for the women.
