Those Who Spoke Regarding Intercourse with Captive Magian Women

٣٤٨٤٢ - حدثنا جرير بن عبد الحميد عن موسى بن ابي عائشة (قال) (١): سالت مرة عن الرجل يشتري او يسبي المجوسية ثم يقع عليها قبل ان تعلم الإسلام، قال: لا يصلح.

Hazrat Musa bin Abi Aisha (may Allah be pleased with her, may Allah have mercy on her) says that I asked Hazrat Murrah (may Allah have mercy on him) about a man who bought or captured a Magian woman and then had intercourse with her before teaching her Islam, so what is the ruling on this? He (may Allah have mercy on him) replied: This is not a correct action. And the narrator says: I asked Hazrat Saeed bin Jubair (may Allah have mercy on him), so he (may Allah have mercy on him) said: When he did such an act, he did not do good to her.

34843 - He said: I asked Sa'id ibn Jubayr and he said: It is not better than her if he does that.

٣٤٨٤٤ - حدثنا وكيع قال: ثنا سفيان عن موسى بن ابي عائشة قال: سالت مرة بن شراحيل الهمداني وسعيد بن جبير عن الامة المجوسية يصيبها الرجل، ايطؤها، قال: لا يجامعها حتى تسلم.
Hazrat Musa bin Abi Aisha (may Allah be pleased with her, may Allah have mercy on her) says that I asked Hazrat Murrah bin Shurahbil Al-Hamdani and Hazrat Saeed bin Jubair (may Allah have mercy on him) about a Magian slave girl: when a man keeps her, can he have intercourse with her? Hazrat Murrah said: He should not have intercourse with her until she accepts Islam. And Hazrat Saeed bin Jubair (may Allah have mercy on him) said: If he returns to her again, then this is a bad thing for him.

34845 - Sa'id ibn Jubayr said: If he returns to it, it is worse than it.

٣٤٨٤٦ - حدثنا عبد الاعلى عن برد عن مكحول قال: إذا كانت وليدة مجوسية فإنه لا ينكحها حتى تسلم.
Hazrat Mak’hool (may Allah have mercy on him) says that when a girl is a Magian, do not marry her until she accepts Islam.

٣٤٨٤٧ - حدثنا عيسى بن يونس (عن الاوزاعي) (١) عن الزهري سمعه يقول: (لا يقرب) (٢) المجوسية حتى تقول: لا إله إلا الله فإذا قالت ذلك فهو منها إسلام.
ريفرينس و تحكيم الحدیث:
(١) سقط من: [أ، هـ].
(٢) في [هـ]: (لا نقرب).
Imam Awza'i (may Allah have mercy on him) says that Hazrat Zuhri (may Allah have mercy on him) said: Do not go near a Magian until he says La ilaha illallah. So when he recites this, Islam will be assumed on his behalf.

٣٤٨٤٨ - حدثنا وكيع قال: ثنا شريك عن سماك عن ابي سلمة بن عبد الرحمن قال: (لا) (١) يطاها حتى تسلم.

Hazrat Simak (may Allah have mercy on him) narrates that Hazrat Abu Salamah bin Abdur Rahman (may Allah have mercy on him) said: Do not have intercourse with her until she accepts Islam.

٣٤٨٤٩ - حدثنا وكيع قال: ثنا سفيان عن قيس بن مسلم عن الحسن بن محمد قال: كتب رسول الله ﷺ إلى مجوس هجر يعرض عليهم الإسلام، فمن اسلم قبل منه، ومن ابى ضربت عليه الجزية، غير ان لا تؤكل لهم ذبيحة ولا (تنكح) (١) منهم امراة (٢).

(٢) مرسل؛ الحسن بن محمد تابعي، أخرجه عبد الرزاق (١٠٠٢٨)، وأحمد في مسائل صالح (٨٣٦)، وأبو عبيد في الأموال (٧٦)، والبيهقي ٩/ ٢٨٤.
Hazrat Hasan bin Muhammad (may Allah have mercy on him) narrates that the Messenger of Allah (peace and blessings be upon him) wrote a letter to the Magians of Hajr, inviting them to Islam. So, whoever among them accepted Islam, his Islam was accepted. And whoever refused, jizya was imposed upon him. Except that their slaughtered animals would not be eaten, and their women would not be married.

٣٤٨٥٠ - حدثنا حاتم بن وردان عن يونس عن الحسن في المجوسية تكون عند الرجل، قال: لا (يطؤها) (١).

(١) في [ط، هـ]: (يطأها)، وفي [ب، جـ، س]: (يبطها)، وفي [ع]: (يتطيها).
Yunus (may Allah have mercy on him) says that Hasan (may Allah have mercy on him) said regarding the man who has a Magian slave-girl: he should not have intercourse with her.

٣٤٨٥١ - حدثنا جرير عن مغيرة عن حماد عن إبراهيم قال: إذا سبيت ⦗٢٤١⦘ المجوسيات (وعبدة) (١) الاوثان عرض (عليهن) (٢) الإسلام و (اجبرن) (٣) (عليه) (٤) فإن اسلمن وطئن واستخدمن، كان ابين ان يسلمن استخدمن ولم (يوطان) (٥).

Hazrat Hammad (may Allah have mercy on him) says that Ibrahim (may Allah have mercy on him) stated: When Magian women or idolater women are captured, Islam will be presented to them and they will be compelled to accept Islam. If they accept Islam, then intercourse will be permitted with them and they will be made to serve. And if they refuse to accept Islam, then service will be taken from them but intercourse will not be permitted with them.
