Those Who Gave the Imam Discretion Regarding the Muharib (Highway Robber)

٣٤٩٩٦ - حدثنا هشيم بن بشير عن حجاج عن عطاء.
Hazrat Mujahid (may Allah have mercy on him), Hazrat Ata (may Allah have mercy on him), Hasan (may Allah have mercy on him), and Hazrat Dahhak (may Allah have mercy on him), all these personalities state that the Imam has been given authority regarding the warrior.

٣٥٠٠٠ - وجويبر عن الضحاك قالوا: الإمام مخير في المحارب.
35000 - Wujaybir from al-Dahhak said: They said: The imam has a choice regarding the highwayman.

٣٥٠٠١ - حدثنا حفص عن عاصم عن الحسن قال: تلى هذه الآية: ﴿إنما جزاء الذين يحاربون الله ورسوله﴾ قال: ذلك إلى الإمام.
Hazrat Asim (may Allah have mercy on him) says that Hasan (may Allah have mercy on him) recited this verse: "The only recompense of those who wage war against Allah and His Messenger صلی اللہ علیہ وسلم ..." And he said: This authority belongs to the Imam.

٣٥٠٠٢ - حدثنا ابو اسامة عن محمد بن عمرو عن عمر بن عبد العزيز قال: السلطان ولي (قتلى) (١) من حارب الدين وان قتل اخا امرئ واباه، فليس إلى من يحارب الدين ويسعى في الارض فسادا سبيل -يعني دون السلطان، ولا يقصر عن الحدود بعد ان تبلغ إلى الإمام، فإن إقامتها من السنة.

Hazrat Umar bin Abdul Aziz says that the ruler is responsible for executing the person who causes corruption in religion. No one except the ruler has this authority. When the prescribed punishments reach the Imam, there is no way for them to be pardoned, and enforcing them is Sunnah.

٣٥٠٠٣ - حدثنا زيد بن الحباب عن ابي هلال (عن قتادة) (١) عن سعيد بن المسيب في المحارب إذا رفع إلى الإمام يصنع به ما شاء.

Hazrat Qatadah (may Allah have mercy on him) says that Hazrat Saeed bin Al-Musayyib (may Allah have mercy on him) said regarding the Muharib: when he is brought before the Imam, the Imam has the authority to deal with him as he wishes.
