On Excessive Transactions in War Booty

٣٥١٧١ - حدثنا ابن عيينة عن ابن ابي نجيح عن مجاهد قال: لا باس ببيع من يزيد، كذلك كانت تباع الاخماس.
Hazrat Ibn Abi Najeeh (may Allah have mercy on him) narrates that Hazrat Mujahid (may Allah have mercy on him) said: There is no harm in selling with an increase. In the same way, the wealth of khums used to be sold.

٣٥١٧٢ - حدثنا إسماعيل بن عياش عن عمرو بن مهاجر ان عمر بن عبد العزيز بعث عميرة بن (زيد) (١) الفلسطيني يبيع السبي فيمن يزيد.
ريفرينس و تحكيم الحدیث:
(١) في [س]: (يزيد)، وهو الموافق لما تقدم في كتاب البيوع ٦/ ٥٥ باب (٢٤) برقم [٢١٤٠٨]، وورد الأثر عند عبد الرزاق (١٤٨٨٢)، والمحلى ٤٨/ ٤٤٨، وسمي الرجل: (عبيد بن مسلم).
Hazrat Amr bin Muhajir (may Allah have mercy on him) narrates that Hazrat Umar bin Abdul Aziz (may Allah have mercy on him) sent Umairah bin Yazid Filastini to sell the captives to the person who would pay the highest price.

٣٥١٧٣ - حدثنا حفص بن غياث عن اشعث عن الحسن وابن سيرين انهما كرها بيع من يزيد إلا بيع المواريث والغنائم.
Hazrat Ash'ath (may Allah have mercy on him) states that Hazrat Hasan Basri (may Allah have mercy on him) and Hazrat Ibn Sirin (may Allah have mercy on him), both of these personalities, considered a sale involving excess to be disliked, except for the sale of inheritance and spoils of war.

٣٥١٧٤ - حدثنا (عيسى) (١) بن يونس ومعتمر بن سليمان عن الاخضر بن عجلان عن ابي بكر الحنفي عن انس بن مالك ان النبي ﷺ باع حلسا وقدحا فيمن يزيد (٢).

(٢) مجهول؛ لجهالة أبي بكر عبد اللَّه الحنفي، أخرجه أحمد (١١٩٦٨)، والنسائي ٧/ ٢٥٩، وأبو داود (١٦٤١)، وابن ماجه (٢١٩٨)، وابن الجارود (٥٦٩)، والطحاوي ٢/ ١٩، والبيهقي ٧/ ٢٥، والضياء في المختارة (٢٢٦٥)، والبخاري في التاريخ الكبير ٢/ ٦٦، وأبو نعيم في الحلية ٣/ ١٣٢، والطبراني في الأوسط (٢٦٤٠)، والمزي ١٦/ ٣٣٩، وابن عبد البر ١٨/ ٣٢٨، والحارث (٣٠٧/ بغية).
Hazrat Anas bin Malik (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) sold a mat and a bowl to the person who offered the highest price. Hazrat Mu'tamir states that this narration was reported by Hazrat Anas (may Allah be pleased with him) from the Messenger of Allah (peace and blessings be upon him) through an Ansari companion.

٣٥١٧٥ - إلا ان معتمرا قال: عن اثس (بن مالك) (١) عن رجل من الانصار عن النبي ﷺ (٢).

(٢) مجهول، أخرجه الترمذي في العلل (٣١٢)، والضياء (٢٢٦٥)، وابن حزم في المحلى ٨/ ٤٤٨؛ وانظر: ما قبله.
35175 - Except that Mu'tamir said: from Aths (ibn Malik) (1) from a man of the Ansar from the Prophet صلی اللہ علیہ وسلم (2).

٣٥١٧٦ - حدثنا الفضل بن دكين عن حماد بن سلمة عن ابي جعفر الخطمي ان المغيرة بن شعبة باع المغانم فيمن يزيد (١).
ريفرينس و تحكيم الحدیث:
(١) صحيح.
Hazrat Abu Ja'far Khatmi (may Allah have mercy on him) narrates that Hazrat Mughirah bin Shu'bah (may Allah be pleased with him) sold the spoils of war in the form of "Bai' Mun Yazeed".

٣٥١٧٧ - حدثنا وكيع قال: ثنا حزام بن هشام عن ابيه قال: شهدت عمر باع إبلا من إبل الصدقة فيمن يزيد (١).

(١) حسن؛ حزام بن هشام صدوق، أخرجه البيهقي ٤/ ٧.
Hazrat Hisham (may Allah have mercy on him) narrates that I was present with Hazrat Umar (may Allah be pleased with him). He (may Allah be pleased with him) sold one of the camels from the camels of charity with an excess in the sale.

٣٥١٧٨ - حدثنا وكيع عن سفيان عن يونس عن ابن سيرين قال: لا باس ببيع المزايدة.
Yunus (may Allah have mercy on him) says that Ibn Sirin (may Allah have mercy on him) said: There is no harm in a sale with an increase.

٣٥١٧٩ - حدثنا حاتم بن وردان عن برد عن مكحول انه كان يكره بيع من يزيد إلا الشركاء بينهم.
Hazrat Burd (may Allah have mercy on him) says that Hazrat Mak'hool (may Allah have mercy on him) considered the sale by one who exceeds his right as disliked, except when the sale is conducted with the mutual consent of the partners.

٣٥١٨٠ - حدثنا جرير عن مغيرة عن حماد قال: لا باس ببيع من يزيد: ان يزيد في السوم إذا اردت ان تشتري.
Hazrat Mughira, may Allah have mercy on him, narrates that Hazrat Hammad, may Allah have mercy on him, said: There is no harm in a sale with an increase. And that is when you intend to buy, you increase the price.
