كِتَابُ التَّفْسِيرِ
Book of Tafsir (Quranic Exegesis)
قَوْلُهُ تَعَالَى: {وَاسْتَشْهِدُوا شَهِيدَيْنِ مِنْ رِجَالِكُمْ فَإِنْ لَمْ يَكُونَا رَجُلَيْنِ فَرَجُلٌ وَامْرَأَتَانِ مِمَّنْ تَرْضَوْنَ مِنَ الشُّهَدَاءِ}
His saying, Exalted is He: {And bring to witness two witnesses from among your men. And if there are not two men [available], then a man and two women from those whom you accept as witnesses.}

Hadith Number: 455
نا نا سفيان ، عن عمرو بن دينار ، عن ابن ابي مليكة , قال: كتبت إلى ابن عباس , اساله عن شهادة الصبيان، فكتب إلي:" إن الله عز وجل يقول: ممن ترضون من الشهداء سورة البقرة آية 282 , فليسوا ممن نرضى، لا تجوز" .
Ibn Abi Mulaykah (may Allah have mercy on him) narrates: I wrote to Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) and asked about the testimony of children. So he wrote back to me: "Allah, the Mighty and Majestic, says: ﴿mimman tardawna min ash-shuhada’﴾ meaning, 'from among those whose testimony you are pleased with.' Children are not among those whose testimony we consider reliable, therefore their testimony is not permissible."

Hadith Number: 456
نا إسماعيل بن زكريا ، عن سفيان الثوري ، عن ابن ابي نجيح ، عن مجاهد في قوله عز وجل: " واستشهدوا شهيدين من رجالكم سورة البقرة آية 282، قال: من الاحرار" .
Mujahid (may Allah have mercy on him) regarding this verse: "And call to witness two witnesses from among your men" says: "By this is meant free men."

Hadith Number: 457
نا هشيم ، قال: نا داود بن ابي هند ، قال: سالت مجاهدا ، عن الظهار من الامة، فقال: " ليس بشيء"، فقلت: اليس الله يقول: والذين يظاهرون من نسائهم سورة المجادلة آية 3، افلسن من النساء؟، فقال:" والله يقول: واستشهدوا شهيدين من رجالكم سورة البقرة آية 282، افتجوز شهادة العبيد؟" .
Mujahid (may Allah have mercy on him) was asked: If a person pronounces zihar on his slave woman, what is the ruling? He replied: "This zihar is nothing." It was asked: "Did Allah Almighty not say: ﴿وَالَّذِينَ يُظَاهِرُونَ مِنْ نِسَائِهِمْ﴾ 'And those who pronounce zihar from their wives,' so are slave women not included among women?" Upon this, Mujahid (may Allah have mercy on him) said: "Allah Almighty also said: ﴿وَاسْتَشْهِدُوا شَهِيدَيْنِ مِنْ رِجَالِكُمْ﴾ 'And take two male witnesses from among your men,' so is the testimony of slaves permissible?" That is, just as in the matter of testimony, the condition of men is specified and slaves are not included, similarly in the ruling of 'wives,' free women are meant, not slave women.
