Hadith Number: 9
الاخ للام والاب اولى بالميراث من الاخ للاب،
A brother who shares both mother and father (i.e., a full brother) takes precedence in inheritance over a brother who shares only the father (consanguine brother).

والاخ للاب اولى من ابن الاخ من الام والاب،
A brother from the father's side takes precedence over the son of a brother from both the mother and father's side (i.e., the real nephew).

وابن الاخ للام والاب اولى من ابن الاخ للاب،
The son of a brother who is related from both the mother and the father takes precedence over the son of a brother who is related from the father’s side only.

وابن الاخ للاب اولى من ابن ابن الاخ للام والاب،
The son of a paternal half-brother is given precedence over the grandson of a full brother (i.e., the son of a real nephew).

والعم اخو الاب للام والاب اولى من العم اخي الاب للاب،
The paternal uncle who is related from both the mother and the father (i.e., the real uncle) takes precedence in inheritance over the paternal uncle who is related only from the father's side (consanguine uncle).

والعم اخو الاب - اراه قال: للاب - اولى من ابن العم اخي الاب للام والاب،
Father’s brother (uncle) — I think he said:“from the father’s side”— he is given precedence over the son of the uncle who is a brother from both the mother and the father (i.e., the real paternal cousin).

وابن العم للاب اولى من عم الاب اخي ابي الاب للام والاب،
And the paternal uncle’s son from the father’s side is given precedence over the grandfather’s brother (i.e., the great-grandfather’s son) who is related from both the mother’s and father’s side.

وكل ما سئلت عنه من ميراث العصبة فإنها على نحو هذا، ما سئلت عنه من ذلك فانسب المتوفى وانسب من ينازع في الولاية من عصبته، فإن وجدت منهم احدا يلقى المتوفى إلى اب لا يلقاه من سواه منهم إلا إلى اب فوق ذلك، فاجعل الميراث للذي يلقاه إلى الاب الادنى دون الآخرين، وإذا وجدتهم يلقونه كلهم إلى اب واحد يجمعهم جميعا، فانظر اقعدهم في النسب، فإن كان ابن اب قط فاجعل الميراث له دون الاطراف، وإن كان الاطراف من ام واب، فإن وجدتهم مستوين ينتسبون من عدد الآباء إلى عدد واحد حتى يلقوا نسب المتوفى وكانوا كلهم بنين بني اب او بني اب وام، فاجعل الميراث بينهم بالسواء، وإن كان والد بعضهم اخا والد ذلك المتوفى لامه وابيه، وكان والد من سواه إنما هو اخو والد ذلك المتوفى لابيه قط، فإن الميراث لبني الاب والام،
And whatever you are asked about the inheritance of ‘Asabah, then it is according to this principle. Whatever you are asked about it, mention the lineage of the deceased and the lineage of the ‘Asabah who is disputing the right of inheritance. Then if you find among them someone who reaches the deceased through a father to whom none of the others among them reaches except through a father above him, then give the inheritance to the one who reaches the deceased through the nearer father, and do not give it to the others.

والجد ابو الاب اولى من ابن الاخ للاب والام، واولى من العم اخي الاب للام والاب،
The grandfather (that is, the father’s father) takes precedence in inheritance over the son of a brother who shares both mother and father (that is, the real nephew), and likewise, he takes precedence over the paternal uncle who shares both mother and father (that is, the real uncle).

ولا يرث ابن الاخ للام برحمه تلك شيئا، ولا الجد ابو الام برحمه تلك شيئا، ولا العم اخو الاب للام برحمه تلك شيئا، ولا الخال برحمه تلك شيئا، ولا ترث الجدة ام ابي الام، ولا ابنة الاخ للام والاب، ولا العمة اخت الاب للام والاب، ولا الخالة، ولا من هو ابعد نسبا من المتوفى ممن سمي في هذا الكتاب، لا يرث احد منهم برحمه تلك شيئا
And the son of a brother who is related through the mother (i.e., uterine nephew) does not inherit anything due to this relationship (i.e., womb).
Similarly, the mother’s father (maternal grandfather) does not inherit anything due to this relationship.
And the uncle who is related through the mother also does not inherit anything due to this relationship.
And the maternal uncle also does not inherit anything due to this relationship.
Likewise, the grandmother (i.e., the mother of the mother’s father), and the daughter of a brother who is related through both parents (i.e., real niece), and the sister of the father who is related through both parents (i.e., real paternal aunt), and the maternal aunt also (do not inherit anything).
And whoever is even more distantly related to the deceased than these, if any of them are mentioned in this book, then none of them inherit anything due to this relationship.
Similarly, the mother’s father (maternal grandfather) does not inherit anything due to this relationship.
And the uncle who is related through the mother also does not inherit anything due to this relationship.
And the maternal uncle also does not inherit anything due to this relationship.
Likewise, the grandmother (i.e., the mother of the mother’s father), and the daughter of a brother who is related through both parents (i.e., real niece), and the sister of the father who is related through both parents (i.e., real paternal aunt), and the maternal aunt also (do not inherit anything).
