Book of Agnatic Guardianship ('Asabah)
مِيرَاثُ امْرَأَةٍ وَأَبَوَيْنِ وَزَوْجٍ وَأَبَوَيْنِ
Inheritance of a woman, two parents, a husband, and two parents
Hadith Number: 11
سعيد قال: نا سفيان بن عيينة، قال: انا منصور، عن إبراهيم، عن علقمة، قال: قال عبد الله: كان عمر بن الخطاب إذا سلك بنا طريقا فاتبعناه وجدناه سهلا، وإنه سئل عن امراة وابوين، فقال: «للمراة الربع، وللام ثلث ما بقي، وما بقي فللاب»
Sa'id said: Sufyan bin 'Uyaynah narrated to us, he said: Mansur narrated to us, from Ibrahim, from Alqamah, he said: Abdullah said: Whenever Umar bin Al-Khattab took us on a path and we followed him, we found it easy. And he was asked about a woman and her two parents, so he said: «لِلْمَرْأَةِ الرُّبُعُ، وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ، وَمَا بَقِيَ فَلِلْأَبِ»

Hadith Number: 11
سعيد قال: نا هشيم، قال: انا الاعمش، قال: نا إبراهيم، قال: قال عبد الله بن مسعود: إن عمر كان إذا اخذ بنا طريقا فسلكناه وجدناه سهلا، وإنه اتي في امراة وابوين، فجعلهما من اربعة اسهم، للمراة الربع، وللام ثلث ما بقي، وللاب ما بقي، وهو سهمان"
Sa'id said: Hushaym narrated to us, he said: Al-A'mash narrated to us, he said: Ibrahim narrated to us, he said: Abdullah bin Mas'ud said: Indeed, whenever Umar took us on a path and we followed it, we found it easy. And he was brought a case concerning a woman and her two parents, so he made their shares from four parts: for the woman, one fourth; for the mother, one third of what remained; and for the father, what remained, which is two shares.

سعيد قال: نا ابو معاوية، قال: نا الاعمش، عن إبراهيم، قال: اتي عبد الله في امراة وابوين، فقال: «إن عمر بن الخطاب كان إذا سلك بنا طريقا سلكناه، وانه اتي في امراة وابوين، فجعلهما من اربعة اسهم، اعطى المراة الربع، واعطى الام ثلث ما بقي، واعطى الاب سائر ذلك»
Sa'id said: Abu Mu'awiyah narrated to us, he said: Al-A'mash narrated to us, from Ibrahim, he said: 'Abdullah was asked about a woman and her two parents, so he said: «إِنَّ عُمَرَ بْنَ الْخَطَّابِ كَانَ إِذَا سَلَكَ بِنَا طَرِيقًا سَلَكْنَاهُ، وَأَنَّهُ أُتِيَ فِي امْرَأَةٍ وَأَبَوَيْنِ، فَجَعَلَهُمَا مِنْ أَرْبَعَةِ أَسْهُمٍ، أَعْطَى الْمَرْأَةَ الرُّبُعَ، وَأَعْطَى الْأُمَّ ثُلُثَ مَا بَقِيَ، وَأَعْطَى الْأَبَ سَائِرَ ذَلِكَ»

سعيد قال: نا هشيم، قال: انا خالد، عن ابي قلابة، ان عثمان بن عفان «اتي في امراة وابوين، فجعلهما من اربعة»
Saeed said: Hashim narrated to us, he said: Khalid narrated to us, he narrated from Abi Qilabah that: A case regarding a woman and parents (in inheritance) was presented to Uthman bin Affan, may Allah be pleased with him, so he divided it into four parts.

سعيد قال: نا خالد بن عبد الله، عن خالد، عن ابي قلابة، عن عثمان بن عفان «في امراة وابوين، فاعطى المراة الربع سهما، واعطى الام ثلث ما بقي سهما، واعطى الاب ما بقي سهمين»
Sa'id said: Khalid bin Abdullah narrated to us, from Khalid, from Abi Qilabah, and he from Uthman bin Affan (may Allah be pleased with him), that: Regarding a woman and parents (in inheritance), he gave the woman one fourth (one share), the mother one third of the remainder (one share), and the father the remaining two shares.

سعيد قال: نا هشيم، قال: انا خالد، عن ابي قلابة، عن زيد بن ثابت، انه قال في زوج وابوين، فجعلها من ستة، للزوج ثلاثة اسهم، وللام ثلث ما بقي سهما، وما بقي فللاب سهمان".
Saeed said: Hashim narrated to us, he said: Khalid narrated to us, from Abi Qilabah, and he from Zaid bin Thabit (may Allah be pleased with him) who said regarding the inheritance of the husband and parents: It is divided into six parts, the husband is given three parts, the mother is given one third of the remainder (one part), and the father is given the remaining two parts.

Hadith Number: 12
نا هشيم، قال: انا ابن ابي ليلى، عن الشعبي، عن عبد الله ، وزيد بن ثابت ، مثل ذلك.
It is narrated from Sha'bi (may Allah have mercy on him) that Sayyiduna Abdullah bin Mas'ud and Sayyiduna Zaid bin Thabit (may Allah be pleased with them both) also gave the same verdict (i.e., regarding the division of inheritance between the husband and the parents).

Hadith Number: 13
نا نا هشيم، عن حجاج بن ارطاة، قال: نا شيخ من همدان، عن الحارث، عن علي ، انه قال في زوج وابوين،" فجعل للزوج النصف ثلاثة اسهم، وللام ثلث ما بقي، وللاب سهمين" .
It is narrated from a sheikh of Hamdan, who narrates from Harith, and he narrates from Sayyiduna Ali (may Allah be pleased with him) that when the case of the husband and parents was presented, he gave the husband half, that is, three parts, gave the mother one third of the remaining wealth, and gave the father the remaining two parts.

Hadith Number: 14
نا نا ابو شهاب، عن حجاج، عمن سمع عبد الله بن محمد بن علي، عن ابيه، عن علي ، انه قال: " في زوج وابوين، للزوج النصف وللام ثلث ما بقي" .
Abdullah bin Muhammad bin Ali narrated from his father from Sayyiduna Ali (may Allah be pleased with him) that he said: "In the matter of inheritance between a husband and parents, the husband will receive half, and the mother will be given one third of the remaining wealth."

Hadith Number: 15
نا نا هشيم، قال: انا ابن ابي ليلى، عن الشعبي، ان عليا ، قال: " للام ثلث ما بقي" .
It is narrated from Sha'bi (may Allah have mercy on him) that Sayyiduna Ali (may Allah be pleased with him) said: "The mother has one third of the remaining estate."
