Chapter on paternal and maternal aunts
Hadith Number: 163
نا عبد العزيز بن محمد ، قال: حدثني زيد بن اسلم ، عن عطاء بن يسار " ان رسول الله صلي الله عليه وسلم ركب إلى قبا يستخير الله في العمة والخالة، فانزل عليه ان لا ميراث لهما" .
The Messenger of Allah ( صلی اللہ علیہ وسلم ) rode towards Quba to seek goodness from Allah regarding the paternal and maternal aunt, so Allah revealed: "They have no inheritance."

Hadith Number: 164
نا ابو شهاب ، عن محمد بن يحيى بن حبان ، عن عمه واسع بن حبان , قال: توفي ثابت بن الدحداحة ولم يدع وارثا ولا عصبة، فرفع شانه إلى رسول الله صلي الله عليه وسلم، فسال عنه رسول الله صلي الله عليه وسلم عاصم بن عدي: " هل ترك من احد"؟ قال: ما يا رسول الله ترك احدا. فدفع رسول الله صلي الله عليه وسلم ماله إلى ابن اخته ابي لبابة بن عبد المنذر" .
The case of Thabit bin Dahdahah (may Allah be pleased with him) was brought before the Messenger of Allah (peace and blessings be upon him). He had left behind neither an heir nor an agnate. So the Prophet (peace and blessings be upon him) handed over his wealth to his nephew, Abu Lubabah bin Abdul Mundhir.

Hadith Number: 165
نا نا ابو عوانة، عن الاعمش، عن إبراهيم، ان عمر ، وابن مسعود " كانا يورثان العمة والخالة إذا لم يكن غيرهما" .
Sayyiduna Umar bin Khattab (may Allah be pleased with him) and Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with them both) used to make the paternal aunt and maternal aunt heirs when there was no one else besides them.

Hadith Number: 166
نا نا سفيان، عن الاعمش، عن إبراهيم، قال: قال عبد الله : " الام عصبة من لا عصبة له، والاخت عصبة من لا عصبة له" .
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: "The mother is the 'Asabah (agnatic heir) of the one who has no 'Asabah, and the sister is the 'Asabah of the one who has no 'Asabah."

Hadith Number: 167
نا نا عتاب بن بشير، عن خصيف، عن زياد بن ابي مريم، قال:" مات إنسان على عهد عمر بن الخطاب ولم يترك إلا عمة وخالة، فاعطى عمر العمة الثلثين، والخالة الثلث" .
It is narrated from Ziyad bin Abi Maryam (may Allah have mercy on him) that when a person died, Sayyiduna Umar bin Khattab (may Allah be pleased with him) gave two-thirds to his paternal aunt and one-third to his maternal aunt.

Hadith Number: 168
نا إسماعيل بن عياش ، عن النضر بن شفي ، عن عمران بن سليم ، ان رجلا انقعر عن مال له، فاتت ابنة اخته رسول الله صلي الله عليه وسلم تساله الميراث، فقال:" لا شيء لك، اللهم من منعت ممنوع، اللهم من منعت ممنوع" .
A woman came to the Messenger of Allah ( صلی اللہ علیہ وسلم ) claiming her uncle’s wealth. The Prophet ( صلی اللہ علیہ وسلم ) said:“There is nothing for you. O Allah! Whomever You have deprived, he is deprived.”

Hadith Number: 169
نا نا سفيان، عن الاعمش، عن إبراهيم، عن عبد الله ، قال: " ذو السهم احق ممن لا سهم له" .
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: "The one with a prescribed share takes precedence over the one without a prescribed share."

Hadith Number: 170
نا نا إسماعيل بن عياش، عن ابي بكر بن ابي مريم عن راشد بن سعد، وضمرة بن حبيب، ومكحول، وعطية بن قيس، عن زيد بن ثابت ، قال: " لا يرث ابن اخت، ولا ابنة اخ، ولا بنت عم، ولا خال، ولا عمة، ولا خالة" .
Sayyiduna Zaid bin Thabit (may Allah be pleased with him) said: "A nephew, niece, paternal uncle's daughter, maternal aunt, paternal aunt, and maternal uncle—none of them become heirs."

Hadith Number: 171
نا سفيان ، عن ابن طاوس ، عن ابيه " ان رسول الله صلي الله عليه وسلم مولى من لا مولى له، والخال وارث من لا وارث له" .
The Messenger of Allah, peace and blessings be upon him, said: "I am the guardian of the one who has no guardian, and the maternal uncle is the heir of the one who has no heir."

Hadith Number: 172
نا عبد الرحمن بن زياد ، قال: نا شعبة ، عن بديل بن ميسرة ، قال: سمعت علي بن ابي طلحة يحدث عن راشد بن سعد ، عن ابي عامر الهوزني ، عن المقدام رجل من اهل الشام وكان من اصحاب النبي صلي الله عليه وسلم , عن النبي صلي الله عليه وسلم , قال: " من ترك كلا فإلينا، ومن ترك مالا فلورثته، وانا وارث من لا وارث له، اعقل عنه وارثه، والخال وارث من لا وارث له، يعقل عنه ويرثه" .
Miqdam (may Allah be pleased with him) narrated from the Messenger of Allah (peace and blessings be upon him) that he said: "Whatever wealth someone leaves behind, it is for his heirs, and I am the heir of the one who has no heir. I pay the blood money on his behalf and become his heir, and the maternal uncle is the heir of the one who has no heir."
