Sunan Saeed bin Mansur
كِتَابُ وِلَايَةِ الْعَصَبَةِ
Book of Agnatic Guardianship ('Asabah)
بَابُ النَّهْيِ عَنْ بَيْعِ الْوَلَاءِ وَهِبَتِهِ
Chapter on the prohibition of selling or gifting wala' (right of inheritance from freed slaves)
Hadith Number: 276
نا سفيان ، عن عبد الله بن دينار ، عن ابن عمر ، قال:" نهى رسول الله صلى الله عليه وسلم عن بيع الولاء وعن هبته" .
It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: "He forbade selling and gifting guardianship."

Hadith Number: 277
نا نا سفيان، عن ابن ابي نجيح، عن مجاهد، قال: قال علي : " الولاء بمنزلة الحلف لا يباع ولا يوهب، اقروه حيث جعله الله" .
Sayyiduna Ali (may Allah be pleased with him) said: "Wilayah is like a covenant; it can neither be sold nor gifted. Keep it where Allah has placed it."

Hadith Number: 278
نا نا جرير بن عبد الحميد، عن مغيرة، عن إبراهيم , قال: قال عبد الله :" إنما الولاء كالنسب افيبيع الرجل نسبه" .
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: "Wilayah is like lineage; can a person sell his lineage?"

Hadith Number: 279
نا ابو عوانة ، عن عمرو بن ابي سلمة ، عن ابيه ، عن عائشة ، قالت: قال رسول الله صلى الله عليه وسلم: " الولاء لمن اعتق" .
It is narrated from Sayyidah Aisha (may Allah be pleased with her) that the Messenger of Allah (peace and blessings be upon him) said: "Walayah (guardianship) belongs only to the one who set (the slave) free."

Hadith Number: 280
نا نا سفيان، عن عمرو بن دينار، ان ميمونة " وهبت ولاء سليمان بن يسار لابن عباس , وكان مكاتبا" .
It is narrated that Sayyida Maymunah (may Allah be pleased with her) gifted the wala’ of Sulayman bin Yasar to Ibn Abbas (may Allah be pleased with them both) while he was a mukatab (contracted slave).

Hadith Number: 281
نا خالد بن عبد الله ، عن يونس ، عن الحسن ، قال: قال رسول الله صلى الله عليه وسلم: " الميراث للعصبة فإن لم يكن عصبة فالولاء" .
The Messenger of Allah, peace and blessings be upon him, said: "Inheritance is for the agnates (asabat); if there are no agnates, then guardianship will be established."

Hadith Number: 282
نا جرير، عن منصور، قال: سالت إبراهيم عن رجل اعتق نسمة لوجه الله , فانطلق فوالى رجلا , قال:" ليس له ذلك إلا ان يهبه المعتق" .
Ibrahim (may Allah have mercy on him) was asked about a person who freed a slave for the sake of Allah, then that slave went and established allegiance (wala’) with someone else. He replied:“This is not permissible, unless the emancipator himself gifts him (to someone else).”

نا ابو معاوية، قال: نا ابو عاصم الثقفي، عن الشعبي، عن شريح " انه كان يجري الولاء مجرى الميراث" .
Shurayh (may Allah have mercy on him) used to consider guardianship equal to inheritance.

نا إسماعيل بن زكريا، عن داود، عن سعيد بن المسيب، قال: " الولاء لحمة كالنسب لا يباع ولا يوهب" .
Saeed bin Al-Musayyib (may Allah have mercy on him) said: "Walayah is a relationship like lineage; it can neither be sold nor gifted."
