بَابُ مِيرَاثِ الْمَرْأَةِ مِنْ دِيَةِ زَوْجِهَا
Chapter on a woman's inheritance from her husband's blood money
Hadith Number: 295
نا سفيان ، قال: نا الزهري ، سمع سعيد بن المسيب ، يقول: الدية للعاقلة، ولا ترث المراة من دية زوجها شيئا، فقال له الضحاك الكلابي :" كتب إلي رسول الله صلى الله عليه وسلم ان اورث امراة اشيم الضبابي من دية زوجها اشيم" .
Sa'id bin al-Musayyib (may Allah have mercy on him) says: "The blood money (diyah) is upon the 'aqilah (male relatives), and a woman does not receive anything from her husband's blood money." But Dahhak bin Sufyan (may Allah be pleased with him) said: "The Messenger of Allah (peace and blessings be upon him) wrote to me, instructing me to give a share of the blood money to the wife of Ashyam al-Dhibabi."

Hadith Number: 296
نا هشيم ، قال: إن لم اكن سمعته من الزهري ، فقد حدثني سفيان بن حسين ، عن الزهري ، عن سعيد بن المسيب , ان امراة اتت عمر بن الخطاب قتل زوجها فسالت ان يورثها من ديته , فقال: ما اعلم لك شيئا، ثم سال الناس من كان عنده علم من رسول الله صلى الله عليه وسلم , فقام الضحاك بن سفيان الكلابي , فقال:" كتب إلي رسول الله صلى الله عليه وسلم ان اورث امراة اشيم من دية زوجها اشيم فورثها عمر بن الخطاب".
It is narrated from Sa'id bin al-Musayyib (may Allah have mercy on him) that a woman came to Sayyiduna Umar bin Khattab (may Allah be pleased with him) and asked for a share from her husband's blood money. Sayyiduna Umar (may Allah be pleased with him) said: "I do not know anything for you." Then he asked the people if anyone had any knowledge from the Messenger of Allah (peace and blessings be upon him). So Dahhak bin Sufyan (may Allah be pleased with him) stood up and said: "The Messenger of Allah (peace and blessings be upon him) commanded me to make the wife of Ashyam al-Dhibabi an heir in his blood money." So Sayyiduna Umar (may Allah be pleased with him) made that woman an heir.

Hadith Number: 297
نا ابو قدامة ، عن معمر ، عن الزهري ، عن سعيد بن المسيب , قال: جاءت امراة إلى عمر , فقالت: إنها لا تعطى من دية زوجها شيئا، فقال:" لا ارى الدية إلا للعصبة هم يعقلون عنه، فهل عند احد منكم شيء بلغه عن رسول الله صلى الله عليه وسلم؟ فقام الضحاك بن سفيان الكلابي , فقال:" كتب إلي رسول الله صلى الله عليه وسلم في امراة اشيم الضبابي ان اورثها من دية زوجها" فورثها عمر".
Sa'id bin al-Musayyib (may Allah have mercy on him) says: A woman came to Sayyiduna Umar (may Allah be pleased with him) and said that a woman is not given anything from her husband's blood money (diyah). So Sayyiduna Umar (may Allah be pleased with him) said: "The blood money is for the 'aqilah who pay the diyah on his behalf. Does anyone have any command from the Messenger of Allah (peace and blessings be upon him)?" Then Dahhak bin Sufyan (may Allah be pleased with him) stood up and said: "The Messenger of Allah (peace and blessings be upon him) commanded me to make the wife of Ashyam al-Dhababi an heir in his blood money." So Sayyiduna Umar (may Allah be pleased with him) made her an heir.

Hadith Number: 298
نا سفيان ، عن عمرو بن سعيد بن مسروق ، عن الزبير بن عدي ، انه سمع الشعبي ، يقول:" إن رسول الله صلى الله عليه وسلم ورث زوجا من دية" .
Al-Sha'bi, may Allah have mercy on him, said: "The Messenger of Allah, peace and blessings be upon him, made the husband an heir from the blood money (diyah)."

Hadith Number: 299
نا عيسى بن يونس , قال: انا الاعمش ، عن إبراهيم ، قال رسول الله صلى الله عليه وسلم: " الدية على الميراث، والعقل على العصبة" .
The Messenger of Allah (peace and blessings be upon him) said: "The blood money will be distributed according to the heirs, and the payment is upon the 'aqilah (male relatives on the father's side)."

Hadith Number: 300
نا هشيم قال: انا مغيرة، عن إبراهيم انه سئل عن المراة، اترث من دية زوجها؟ فقال إبراهيم:" الدية تقسم على فرائض الله" .
Ibrahim (may Allah have mercy on him) was asked whether a woman would inherit from her husband's blood money (diyah). He replied: "The blood money will be distributed according to the shares prescribed by Allah."

Hadith Number: 301
نا هشيم , قال: انا ابو إسحاق الشيباني , قال: قلت للشعبي:" الإخوة من الام ايرثون من الدية شيئا؟ فقال:" اما انت فقد نظرت المصحف، يرث من الدية كل وارث" .
It was asked from Ash-Sha'bi (may Allah have mercy on him): "Will maternal brothers inherit in blood money?" He replied: "Have you seen the Mushaf? Every heir inherits in blood money."

Hadith Number: 302
نا هشيم ، قال: انا اشعث بن سوار ، قال: انا الشعبي ، عن بعض اصحاب رسول الله صلى الله عليه وسلم , انه قال: " الدية تقسم على الفرائض" .
Ash-Sha'bi (may Allah have mercy on him) narrated from some of the Companions of the Messenger of Allah (peace and blessings be upon him) that: "The blood money (diyah) will be distributed according to the shares prescribed by Allah."

Hadith Number: 303
نا نا سفيان، عن عمرو بن دينار، سمع عبد الله بن محمد بن علي، يقول: قال علي بن ابي طالب : " قد ظلم من منع بني الام نصيبهم من الدية" .
Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) said: "Whoever deprives maternal brothers of blood money has committed injustice."

Hadith Number: 304
نا نا داود بن عبد الرحمن، عن عمرو بن دينار، قال: سمعت محمد بن علي بن حسين، يقول: قال علي : " ظلم من منع بني الام نصيبهم من الدية" .
Sayyiduna Ali (may Allah be pleased with him) said: "Whoever does not give the maternal brothers their share from the blood money has committed injustice."
