كِتَابُ النِّكَاحِ
Book of Marriage
بَابُ الرَّجُلِ يَتَزَوَّجُ الْمَرْأَةَ فَيَمُوتُ وَلَمْ يَفْرِضْ لَهَا صَدَاقًا
Chapter: A man marries a woman and dies without specifying a dowry for her
Hadith Number: 932
نا هشيم، انا زكريا، عن الشعبي، قال:" باب من الطلاق جسيم، إذا ورثت المراة اعتدت" .
Hazrat Sha'bi (may Allah have mercy on him) said: "It is an important issue in the matter of divorce that when a woman receives inheritance, she must observe the waiting period ('iddah)."

Hadith Number: 933
نا خالد بن عبد الله ، عن يونس ، عن الحسن , ان رسول الله صلى الله عليه وسلم , قال في امراة توفي عنها زوجها ولم يفرض لها صداقا , قال:" لها مثل صداق نسائها" .
Sayyiduna Hasan al-Basri (may Allah have mercy on him) attributed to the Prophet (peace and blessings be upon him) that if a woman is married and no dowry (mahr) is fixed, and the husband passes away, then she should be given the mahr equivalent to that of women like her.

Hadith Number: 934
نا إسماعيل بن عياش، قال: حدثني عطاء الخراساني، قال: كتب عمر بن عبد العزيز إلى الناس في الرجل يتزوج المراة، ثم يطلقها قبل ان يدخل بها، وقبل ان يفرض لها" ان لها نصف الصداق، ولا عدة عليها، ولا ميراث لها" .
Hazrat Umar bin Abdul Aziz (may Allah have mercy on him) wrote: "If a man marries, and then divorces before consummation and before fixing the dowry, the woman will receive half the dowry, there will be no waiting period ('iddah), and she will not receive inheritance."
