Sunan Saeed bin Mansur
كِتَابُ الطَّلَاقِ
Book of Divorce
بَابُ الرَّجُلِ يَحْلِفُ إِنْ لَمْ يَضْرِبْ غُلَامَهُ مِائَةَ سَوْطٍ فَامْرَأَتُهُ طَالِقٌ
Chapter: A man swears that unless he beats his slave a hundred lashes, his wife is divorced
Hadith Number: 1148
نا هشيم، قال: انا منصور، عن الحسن , في رجل قال لامراته: إن لم آت البصرة فانت طالق، قال:" هي امراته حتى يموت، فإن مات واحد منهما فلا ميراث بينهما" .
Hasan al-Basri, may Allah have mercy on him, said: If a man says to his wife, "If I do not reach Basra, then you are divorced," then she remains his wife until one of them dies, but there is no inheritance between them.

Hadith Number: 1149
نا هشيم، قال: انا يونس، عن الحسن، انه كان يقول: " لا يقربها حتى يفعل ما حلف عليه" .
Hasan al-Basri (may Allah have mercy on him) said: He should not have relations with his wife until he fulfills the oath.

نا هشيم، قال: انا اشعث بن سوار، عن الشعبي، انه قال في رجل , قال: إن لم يضرب غلامه مائة سوط فامراته طالق , قال:" هي امراته حتى يضرب الغلام او يموت" .
Hazrat Aamir Sha'bi (may Allah have mercy on him) said: Whoever says that if he does not flog his slave a hundred lashes, then his wife is divorced, then she remains his wife until he either flogs the slave or the slave dies.

Hadith Number: 1151
نا خالد بن عبد الله، عن صالح بن مسلم، عن الشعبي، في رجل قال لغلامه: إن لم يضربه فامراته طالق فابق الغلام، فقال:" هي امراته حتى يموت الغلام" . قال سعيد: بئس ما قال.
Hazrat Aamir Sha'bi (may Allah have mercy on him) said: If a slave runs away and the husband says that his wife is divorced until he beats (the slave), then his wife will remain with him until the slave dies.
