كِتَابُ الطَّلَاقِ
Book of Divorce
حَبْلُكِ عَلَى غَارِبِكِ وَنَحْوُ ذَلِكَ مِنَ الْكِنَايَاتِ
Your rope is on your withers and similar expressions of allusive divorce
Hadith Number: 1152
نا نا هشيم، قال: انا منصور، عن عطاء بن ابي رباح، ان رجلا قال لامراته: حبلك على غاربك، قال ذلك مرارا، فاتى عمر بن الخطاب فاستحلفه بين الركن والمقام:" ما الذي اردت بقولك؟" , قال: اردت الطلاق، ففرق بينهما .
A man said to his wife: "Your matter is in your hands." Then he came to Sayyiduna Umar bin Khattab (may Allah be pleased with him). Umar made him swear between the corner and the station of the Ka'bah, asking what his intention was. He said: "My intention was divorce." So Umar (may Allah be pleased with him) separated them.

Hadith Number: 1153
نا نا هشيم، قال: انا منصور، وابن ابي ليلى، وعبد الملك، عن عطاء، ان رجلا قال لامراته: حبلك على غاربك، فاتى عمر بن الخطاب فذكر له ذلك. قال هشيم: قال عبد الملك من بين القوم: فارسل إلى علي بن ابي طالب رضي الله عنه: وافني في الموسم، فوافاه به فاقامه بين الركن والمقام , ثم استحلفه ما اراد بقوله؟" فقال: اما إنها ابنة عمي واكرم الناس علي، ولو اقمتني في غير هذا المقام لعلي , فاما إذ اقمتني في هذا المقام، فإنما اردت فراقها،" ففرق بينهما" .
In a similar incident, Sayyiduna Umar bin Khattab and Ali bin Abi Talib (may Allah be pleased with them) made the parties swear an oath and asked about their intention; when the intention turned out to be separation, they enforced separation.

Hadith Number: 1154
نا هشيم، قال: انا منصور، عن الحسن، في رجل قال لامراته: اذهبي فلا حاجة لي فيك، قال:" هي ثلاث" .
Hasan al-Basri (may Allah have mercy on him) said: Whoever says to his wife, "Go away, I have no need of you," then that is three divorces.

Hadith Number: 1155
نا هشيم، قال: انا مغيرة، عن إبراهيم، انه سئل عن رجل قال لامراته: اذهبي فتزوجي، قال:" ليس بشيء إن لم ينو طلاقا" . فذكرنا ذلك للشعبي , فقال:" والذي يحلف به، إن اهون من هذا ليكون طلاقا".
Ibrahim Nakha'i (may Allah have mercy on him) was asked about a man who said to his wife: "Go, get married." He replied: If he did not intend divorce, then nothing (i.e., no divorce) occurs. Hazrat 'Amir Sha'bi (may Allah have mercy on him) said: By Allah, divorce takes place even on something lighter than this.

Hadith Number: 1156
نا ابو الاحوص، قال: نا مغيرة، عن إبراهيم , في رجل قال لامراته: قد اذنت لك فانكحي من شئت، قال:" ليس بشيء" . قال المغيرة: فسالت الشعبي عن ذلك , فقال: إن اهون من هذا ليكون طلاقا".
Ibrahim Nakha'i (may Allah have mercy on him) said: Whoever says to his wife: "Marry whomever you wish," if he does not intend divorce, then there is nothing (i.e., it does not count as divorce).

Hadith Number: 1157
نا جرير، عن مغيرة، عن إبراهيم , في رجل قال لامراته: قد اذنت لك ان تزوجي، قال:" إن كان عنى طلاقا وإلا فلا شيء".
If there is the intention of divorce, then it is a divorce; otherwise, it is nothing.

Hadith Number: 1158
نا هشيم، قال: نا يونس، عن الحسن، ومحمد بن سالم، عن الشعبي، انهما قالا في رجل قال لامراته: الحقي باهلك، ولا سبيل لي عليك، والطريق لك واسع، قالا:" إن كان نوى الطلاق , فهي واحدة وهو احق بها، وإن لم ينو طلاقا فليس بشيء" .
Hasan al-Basri and 'Amir al-Sha'bi, may Allah have mercy on them, said: Whoever says to his wife: "Go to your (own) house," or says, "I have no right over you," or "The way is open for you," if he intends divorce, then it is one divorce, and the husband has more right to his wife. And if he does not intend (divorce), then there is nothing (i.e., it does not count as divorce).

Hadith Number: 1159
نا هشيم، قال: انا مغيرة، عن إبراهيم، قال: سالته عن رجل قال لامراته: ليست لي بامراة، قال ذلك مرارا، قال:" ما اراه بلغ الثلاث إلا وهو يريد الطلاق" .
Ibrahim Nakha'i (may Allah have mercy on him) said: Whoever repeatedly says, "You are not my wife," I do not think that he would say it three times and not intend divorce.

Hadith Number: 1160
نا خالد بن عبد الله، عن مغيرة، عن إبراهيم، في رجل قال لامراته: ما انت لي بامراة، فاكثر من ذلك، قال:" ما اراه قال ذلك ثلاثا إلا وهو ينوي الطلاق" .
Ibrahim Nakha'i (may Allah have mercy on him) said: Whoever says, "You are not my wife," and repeats it, then if he says it three times and intends divorce, divorce will take place.

Hadith Number: 1161
نا هشيم، قال: انا يونس، عن الحسن، ومغيرة، عن إبراهيم، ويسار، عن الشعبي , انهم قالوا في رجل سئل: الك امراة؟ فقال: لا , وله امراة، قالوا:" هي كذبة" .
Hasan al-Basri, Ibrahim al-Nakha'i, and 'Amir al-Sha'bi, may Allah have mercy on them, said: Whoever is asked, "Do you have a wife?" and he says, "No," while he does have a wife, then this is a lie.
