كِتَابُ الطَّلَاقِ
Book of Divorce
بَابُ الرَّجُلِ يَكُونُ لَهُ أَرْبَعُ نِسْوَةٍ فَيَقُولُ: بَيْنَكُنَّ تَطْلِيقَةٌ
Chapter: A man has four wives and says, "Among you is one divorce"
Hadith Number: 1168
نا هشيم، قال: انا منصور، عن الحسن , في رجل له اربع نسوة , فقال: بينكن تطليقة، قال:" يطلق كل واحدة منهن تطليقة" .
Hasan al-Basri (may Allah have mercy on him) said: If a man has four wives and says: "One divorce among all of you," then one divorce will take place upon each wife.

Hadith Number: 1169
نا عبد الله بن المبارك، عن معمر، عن قتادة، عن الحسن , في رجل قال لاربع نسوة: قسمت بينكن تطليقة , قال:" يطلق كل واحدة واحدة إلى اربع تطليقات، فإن قال: خمس تطليقات، طلقت كل واحدة ثنتين إلى ثمان تطليقات، فإن قال: تسع تطليقات، طلقت كل واحدة ثلاثا" .
Hasan al-Basri (may Allah have mercy on him) said: If a man says to four wives, "You each have one divorce," then each will have one divorce. If he says five, then each will have two divorces. If he says nine, then each will have three divorces.

Hadith Number: 1170
نا هشيم، عن يونس، عن الحسن , في رجل له اربع نسوة , فقال: امراته طالق، ولم يدر ايتهن طلق، قال:" ينوي، فإن لم يكن نوى اعتزلهن جميعا" .
Hasan al-Basri (may Allah have mercy on him) said: If a man says, "My wife is divorced," and it is not known which one, then the decision will be based on his intention. If there is no intention, then he must leave all his wives.

Hadith Number: 1171
نا نا ابو عوانة، عن ابي بشر، عن عمرو بن هرم، عن جابر بن زيد، عن ابن عباس ، في رجل له ثلاث نسوة طلق إحداهن تطليقة، ولم تقع نيته على احد منهن , قال:" ينالهن من الطلاق ما ينالهن من الميراث" .
Abdullah bin Abbas (may Allah be pleased with them both) said: If a man has three wives and he divorces one of them without specifying any particular one, then the divorce will be distributed among them just as inheritance is distributed.

Hadith Number: 1172
نا هشيم، قال: انا ابو بشر، عن عمرو بن هرم، عن جابر بن زيد، عن ابن عباس ، مثله.
This same narration has also come from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) through another chain of transmission.

Hadith Number: 1173
نا نا إسماعيل بن عياش، عن ابن جريج، قال: انا بعض اصحابنا , ان رجلا من اهل عمان استفتى ابن عباس وكان عنده نسوة فطلق إحداهن، فقال ابن عباس:" إن كنت نويتها في نفسك ثم نسيتها فقد ذهبن جميعا، يشتركن في الطلاق كما يشتركن في الميراث، وإن لم تكن نويتهن فايتهن شئت" .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) said: If someone intended divorce in his heart for one (wife) but forgot, then divorce will occur for all; and if there was no intention, then he may divorce whomever he wishes.

Hadith Number: 1174
نا هشيم، قال: انا يونس، عن الحسن، ومغيرة، عن إبراهيم , انهما قالا في رجل طلق امراته تطليقة فلقيه رجل , فقال: طلقت امراتك؟ قال: نعم، ثم لقيه آخر، فقال مثل ذلك، ثم لقيه آخر، فقال مثل قوله الاول، قالا:" نيته إن نوى قوله الاول فإنما هي تطليقة" .
Hasan al-Basri and Ibrahim al-Nakha'i, may Allah have mercy on them, said: If a man divorces his wife and says, "I have divorced you," then says the same to another, then the intention will be considered. If the intention was for the first statement, then only one divorce will occur.

Hadith Number: 1175
نا جرير بن عبد الحميد، عن المغيرة، عن الحارث العكلي , في رجل قال لاربع نسوة له: بينكن ثلاث تطليقات، قال:" تبين كل واحدة بثلاث، وإذا قال لامراته: انت طالق ربعا، او ثلثا، او نصفا فهي تطليقة تامة" .
Hazrat Harith Akli, may Allah have mercy on him, said: If someone says to his four wives, "Three divorces are divided among you," then three divorces will apply to each wife. And if he says, "A quarter, or a third, or half a divorce," then one complete divorce will take place.
