بَابُ مَا جَاءَ فِي خِيَارِ الْأَمَةِ
Chapter: What is reported regarding the choice of a slave woman
Hadith Number: 1260
نا ابو معاوية ، قال: نا الاعمش ، عن إبراهيم ، عن الاسود ، عن عائشة ، قالت: كان زوج بريرة حرا، قالت: فلما اعتقت خيرها رسول الله صلى الله عليه وسلم فاختارت نفسها، واراد اهلها ان يبيعوها ويشترطوا الولاء، فذكر ذلك للنبي صلى الله عليه وسلم , فقال:" اشتريها ثم اعتقيها، فإنما الولاء لمن اعتق" .
Lady Aisha (may Allah be pleased with her) narrates: Barirah's husband was a free man, and when Barirah was freed, the Messenger of Allah (peace and blessings be upon him) gave her the choice, so she chose herself. And Barirah's owners wanted to sell her with the condition of retaining the right of wala', so the Messenger of Allah (peace and blessings be upon him) said: «خریدو اور آزاد کر دو، ولاء اسی کا حق ہے جو آزاد کرے۔»

Hadith Number: 1261
نا ابو معاوية ، قال: نا الاعمش ، قال: لا ادري من حديث إبراهيم سمعته او غيره، عن عائشة انها قالت: يا رسول الله، إن الناس يتصدقون على بريرة فتهدي إلينا، فناكل؟ قال:" نعم إنه عليها صدقة، وهو لكم هدية" .
It is narrated from Sayyida Aisha (may Allah be pleased with her) that she said: "O Messenger of Allah! People give charity to Barirah and she gives it to us as a gift, so can we eat it?" The Messenger of Allah (peace and blessings be upon him) said: "Yes, it is charity for her and a gift for you."

Hadith Number: 1262
نا هشيم ، قال: انا حصين ، عن الشعبي ، قال: كان في بريرة ثلاث قضيات: جعل لها رسول الله صلى الله عليه وسلم الخيار على زوجها، وكان مواليها باعوها من عائشة واشترطوا ان الولاء لهم، فقال رسول الله صلى الله عليه وسلم: " الولاء لمن اعتق"، وتصدق عليها بلحم فاهدته إلى عائشة، فدخل النبي صلى الله عليه وسلم فاراد ان ياكل منه، فقالت: إنه تصدق على بريرة، فقال رسول الله صلى الله عليه وسلم:" هو على بريرة صدقة، وهو لنا هدية" .
Al-Sha'bi (may Allah have mercy on him) said: Three rulings were made regarding Barirah: The Messenger of Allah (peace and blessings be upon him) gave her the choice regarding her husband. Her masters stipulated the condition of wala', so the Prophet (peace and blessings be upon him) said: "Wala' belongs to the one who sets free." Meat that had been given as charity to Barirah was gifted to Lady Aisha (may Allah be pleased with her), so the Prophet (peace and blessings be upon him) said: "It was charity for her, and it is a gift for us."

Hadith Number: 1263
نا ابو عوانة ، عن عمر بن ابي سلمة ، عن ابيه ، عن عائشة رضي الله عنها , قالت: قال رسول الله صلى الله عليه وسلم: " الولاء لمن اعتق" .
It is narrated from Sayyidah Aisha (may Allah be pleased with her) that the Messenger of Allah (peace and blessings be upon him) said: "The right of wala' belongs to the one who sets free."

Hadith Number: 1264
نا خالد، عن مغيرة، عن إبراهيم , في الامة تحت الحر او العبد فتعتق، فقال:" لها الخيار إذا اعتقت" .
Ibrahim al-Nakha'i (may Allah have mercy on him) said: If a slave woman is set free while she is married to a free man or a slave, then she has the right of choice.

Hadith Number: 1265
نا نا ابو علقمة الفروي، قال: نا نافع، قال: قال عبد الله بن عمر : " ايما امة كانت تحت عبد فاعتقت فإن لها الخيار ما لم يمسها" .
It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that he said: If a slave woman is married to a slave and then she is set free, then if the husband has not had intercourse with her, she has the right of choice.
