Book of Divorce
بَابُ الْأَمَةِ تُطَلَّقُ فَتُعْتَقُ فِي الْعِدَّةِ
Chapter: A slave woman is divorced and freed during her waiting period
Hadith Number: 1267
نا هشيم، قال: انا يونس، عن الحسن، وانا إسماعيل بن ابي خالد، عن الشعبي، وعبيدة، عن إبراهيم، قالوا: " إذا طلق الرجل امراته وهي امة تطليقة واحدة فاعتقت في العدة، فعدتها عدة حرة وله عليها رجعة، وإن طلقها تطليقتين فاعتقت في العدة، فعدتها عدة الامة ولا رجعة له عليها" .
Hasan al-Basri, Ibrahim al-Nakha'i, and al-Sha'bi (may Allah have mercy on them) say: If a slave woman is given one divorce and she is freed during her waiting period ('iddah), then her 'iddah will be that of a free woman and the husband will have the right to take her back. But if she is freed after two divorces, then her 'iddah will be that of a slave woman and the husband will not have the right to take her back.

Hadith Number: 1268
نا هشيم، قال: انا منصور، عن رجل، عن سعيد بن المسيب، قال: " تعتد عدة الحرة وله عليها الرجعة، فإذا انقضت العدة فشاء ان يخطبها خطبها" .
It is narrated from Hazrat Saeed bin Musayyib (may Allah have mercy on him): Such a slave-girl, after being freed, will observe the waiting period (‘iddah) of a free woman, and the husband will have the right to take her back. After the completion of the ‘iddah, if he wishes, he can marry her.

Hadith Number: 1269
نا عتاب بن بشير، قال: انا خصيف، عن مجاهد , في الامة تطلق ثم تعتق وهي في العدة، قال:" تستانف عدة الحرة إذا كانت من تطليقة، وإن كانت من تطليقتين فقد بانت تعتد ثلاثة قروء" .
Hazrat Mujahid (may Allah have mercy on him) says: If a slave woman is divorced and she is freed during her waiting period (‘iddah), then if the divorce is one, she will observe the waiting period of a free woman. If there are two divorces, then there will be no return (ruju‘), and she will observe the waiting period of a free woman.

Hadith Number: 1270
نا نا هشيم، قال: انا يحيى بن سعيد، عن عمرو بن دينار، عن عمرو بن اوس، ان عمر بن الخطاب رضي الله عنه , قال: " لو استطعت ان اجعل عدة الامة حيضة ونصف لفعلت" .
Sayyiduna Umar bin Khattab (may Allah be pleased with him) said: If I wished, I would have fixed the waiting period (‘iddah) of a slave woman as one and a half menstruations.

نا نا حماد بن زيد، عن عمرو بن دينار، عن عمرو بن اوس، ان عمر رضي الله عنه , قال: " لو استطعت ان اجعل عدة الامة حيضة ونصف لفعلت، فقال رجل: يا امير المؤمنين فاجعلها شهرا ونصفا، قال: فسكت" .
It is narrated from Sayyiduna Umar bin Khattab (may Allah be pleased with him) that when a person said: "O Commander of the Faithful! Then make it a month and a half for him," Umar (may Allah be pleased with him) remained silent.

Hadith Number: 1272
نا نا سفيان، قال: نا عمرو بن دينار، قال: سمعت عمرو بن اوس، يذكر عن رجل من ثقيف , قال: سمعت عمر بن الخطاب رضي الله عنه على المنبر , يقول: " لو استطعت ان اجعل عدة الامة حيضة ونصف لفعلت، فقال رجل: فاجعلها شهرا ونصفا، قال: فسكت".
Sayyiduna Umar bin Khattab (may Allah be pleased with him) was saying from the pulpit: If I wished, I could have fixed the waiting period (‘iddah) of a slave woman as one and a half menstruations. So a person said: "Then make it one month and a half." So Umar remained silent.

Hadith Number: 1273
نا حماد بن زيد، عن عمرو بن دينار، ان عطاء , كان يقول: " عدة الامة إذا كانت لا تحيض شهران" .
Hazrat Ata (may Allah have mercy on him) says: The waiting period (‘iddah) of a slave woman, if she does not menstruate, is two months.

Hadith Number: 1274
نا نا هشيم، قال: انا مغيرة، عن إبراهيم، عن ابن مسعود , انه كان يقول في عدة الامة:" ايكون عليها نصف العذاب ولا يكون لها نصف الرخصة" .
It is narrated from Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) that he said: "Should there be half the punishment for a slave-girl and no concession?"

Hadith Number: 1275
نا حبان بن علي، قال: انا مغيرة، عن إبراهيم، قال: " طلاق الامة تطليقتان، وعدتها قرءان، وإن كانت لا تحيض فشهر ونصف" .
Ibrahim al-Nakha'i (may Allah have mercy on him) said: The divorce of a slave woman is two times, and her waiting period is two menstruations. And if she does not menstruate, then one and a half months.

Hadith Number: 1276
نا ابو معاوية، قال: نا الاعمش، عن إبراهيم، قال: " طلاق الامة تطليقتان، وعدتها حيضتان". قال:" وإذا استبرئت الامة استبرئت بحيضة" .
Ibrahim Nakha'i (may Allah have mercy on him) said: The divorce of a slave woman is two times and her waiting period ('iddah) is two menstruations. And her Istibra' (waiting period to ensure she is not pregnant) will be one menstruation.
