Book of Divorce
بَابُ مَا جَاءَ فِي الْخُلْعِ
Chapter: What is reported regarding khul' (divorce at wife's request)
Hadith Number: 1414
نا هشيم، قال: انا يونس، عن الحسن، انه كان يقول: " لا يجوز الخلع إلا عند السلطان" .
Hasan (may Allah have mercy on him) said: Khul‘ is only permissible by going to the Sultan.

Hadith Number: 1415
حدثنا هشيم، قال: انا بعض اصحابنا , عن الشعبي، " هم على ما اصطلحوا عليه، وإن كان دون السلطان فهو جائز" .
Hazrat Sha'bi (may Allah have mercy on him) said: Even if khul‘ takes place without the ruler, whatever terms both have agreed upon in reconciliation are permissible.

Hadith Number: 1416
حدثنا هشيم، انا مغيرة، عن الشعبي، قال: قيل له: المراة إذا ارادت ان تختلع من زوجها , تقول لا ابر لك قسما، ولا اطيع لك امرا، ولا اغتسل لك من جنابة. فقال الشعبي:" المراة تفجر، فما تدع الغسل من الجنابة" . كانه كره هذا القول.
Hazrat Sha'bi (may Allah have mercy on him) was asked: If a woman, with the intention of seeking khula, says to her husband, "I will neither respect your oath, nor obey your command, nor perform ghusl after janabah?" Hazrat Sha'bi (may Allah have mercy on him) replied: The woman resorts to sinfulness, but abandoning ghusl after janabah is not appropriate. Thus, he disliked this statement.

Hadith Number: 1417
حدثنا هشيم، نا إسماعيل بن ابي خالد، عن الشعبي، ان امراة، قالت لزوجها: لا ابر لك قسما، ولا اطيع لك امرا، ولا اغتسل لك من جنابة. فقال بيده:" لا افعل، ولا افعل، ايما امراة كرهت زوجها فياخذ منها ويخلي عنها" .
Hazrat Sha'bi (may Allah have mercy on him) said: When a woman says to her husband, "I will neither obey you nor perform ghusl," then the husband should raise his hand and say, "I will neither do anything for you nor fulfill anything." If the woman dislikes her husband, then the husband should take wealth from her and separate from her.

Hadith Number: 1418
حدثنا خالد بن عبد الله، عن عمر بن قيس الماصر، عن عامر الشعبي، قال: كنت جالسا عند شريح، فجاءه رجل وامراة يختصمان إليه، فجعل الرجل , يقول: انا والله لولا مالك عندي لطلقتك. فقالت المراة: هو لك على ان تطلقني. فقال: انت طالق. فقالت: زدني. قال: انت طالق. قالت: زدني. قال: انت طالق. فقلت: ما اراك إلا قد خبت، بانت منك امراتك وغرمت. قال شريح:" دين الله إذا في يدك، هما على ما اصطلحا عليه" .
Hazrat Sha'bi (may Allah have mercy on him) narrates: I was sitting with Hazrat Shurayh (may Allah have mercy on him) when a man and a woman came arguing. The man said: By Allah! If your wealth was not with me, I would have divorced you. The woman said: Leave my wealth and divorce me. The man divorced her and then divorced her two more times. Hazrat Sha'bi (may Allah have mercy on him) said: It seems to me that your wife has separated from you and you have also lost the wealth. Shurayh (may Allah have mercy on him) said: The religion of Allah is in your hands; whatever has happened is valid.

Hadith Number: 1419
حدثنا هشيم، نا إسماعيل بن ابي خالد، عن الشعبي، ان امراة قالت لزوجها: اترك لك ما عليك من صداقي على ان تطلقني. فقال: اشهدوا. فقالت: اشهدوا. قال: فانت طالق. قالت: لا والله , حتى تمرهن ثلاثا. قال: فانت طالق ثلاثا. قالت: قد طلقتني، فاردد علي مالي. فاختصما إلى شريح، فقال جلساء شريح: ما نرى امراتك إلا قد بانت منك، وما نراك إلا قد غرمت مالها. فقال شريح: او ترون ذلك؟ قالوا: نعم. قال: إن الإسلام إذا اضيق من حد السيف. ثم قال للرجل:" اما امراتك فلا تحل لك حتى تنكح زوجا غيرك، واما مالك فلك" .
Hazrat Sha'bi (may Allah have mercy on him) said: A woman said to her husband, "I forgo my dower if you divorce me." The husband said, "Bring witnesses." The woman said the same. The husband gave one divorce. The woman said, "No, not until you give three divorces." The husband then gave three divorces. Afterwards, she began to demand her dower back. When the matter reached Hazrat Shurayh (may Allah have mercy on him), those present said, "Your wife has been separated from you and you have also lost your wealth." Hazrat Shurayh (may Allah have mercy on him) said, "If you think this, then Islam has become narrower than the edge of a sword." Then Hazrat Shurayh (may Allah have mercy on him) said to the husband, "Your wife is not lawful for you until she marries another, but you will get your dower back."

Hadith Number: 1420
حدثنا ابو عوانة، عن مغيرة، عن إبراهيم، في رجل قال لامراته: قد خلعتك، ولم يكن خلعها، فقال:" قد خلعها لها الآن" . وقال حماد: " ليس في مالها شيء" .
Ibrahim (may Allah have mercy on him) said: If a husband says to his wife, "I have granted you khul‘," and he does not intend khul‘, even then khul‘ takes place.
