كِتَابُ الطَّلَاقِ
Book of Divorce
بَابُ الرَّجُلِ يُطَلِّقُ امْرَأَتَهُ ثُمَّ يَقْذِفُهَا فِي عِدَّتِهَا
Chapter: A man divorces his wife, then accuses her during her waiting period
Hadith Number: 1578
حدثنا هشيم، انا مغيرة، عن الحارث العكلي، في رجل قذف امراته ثم اختلعت منه , قال:" هي فرت من الملاعنة فلا حد ولا لعان، وإذا طلقها بعد قذفه إياها فهو فر من الملاعنة , فضرب الحد ولا لعان" .
Hazrat Harith Akli (may Allah have mercy on him) said: If a woman takes khula after being accused of adultery (qadhf), then there is neither li'an nor hadd. And if divorce is given after qadhf, then hadd will be applied but there will be no li'an.

Hadith Number: 1579
حدثنا هشيم، نا عثمان البتي، عن الشعبي، في رجل قذف امراته بشيء قبل ان يتزوجها , قال:" يضرب، ويلاعن وهي امراته" .
Hazrat Sha'bi (may Allah have mercy on him) said: If a man accuses a woman of adultery before marriage, the hadd (punishment) will be enforced, and after marriage, he will perform li'an (mutual cursing).

Hadith Number: 1580
حدثنا هشيم، انا الشيباني، عن الشعبي، قال: " إذا كانوا اربعة شهدوا على امراة بالزنا، احدهم زوجها , قال: يقام عليها الحد" .
Hazrat Sha'bi (may Allah have mercy on him) said: If four men testify against a woman for adultery and one of them is her husband, the prescribed punishment (hadd) will be carried out on the woman.

Hadith Number: 1581
حدثنا هشيم، انا الشيباني، عن الشعبي، قال: " إذا كانوا اربعة فقد احرزوا ظهورهم من الحد، ويقام عليها الحد" . قال الشيباني: وانا حماد، عن إبراهيم , انه كان يقول: " يلاعن الزوج ويجلد الثلاثة" .
Hazrat Sha'bi (may Allah have mercy on him) said: If there are four witnesses, they save themselves from the hadd, and the hadd will be imposed on the woman. Ibrahim (may Allah have mercy on him) said: The husband should perform li'an and the hadd will be imposed on all three.

Hadith Number: 1582
حدثنا حدثنا عبد الرحمن بن ابي الزناد، عن ابيه، عن عبيد الله بن عبد الله، عن ابن عباس ، في اربعة شهدوا على امراة بالزنا، احدهم زوجها , قال:" يلاعن الزوج ويجلد الثلاثة" . قال ابو الزناد: وهذا راي اهل بلدنا، وهو القول.
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that if four men testify, among whom one is the husband, then the husband will perform li'an and the hadd will be imposed on the other three, and this is also the opinion of the people of Madinah.

Hadith Number: 1583
حدثنا ابن المبارك، اخبرني معمر، عن قتادة , عن سعيد بن المسيب، قال: " اللعان تطليقة بائنة، وإن يكذب نفسه جلد، وخطبها إن شاء" .
Hazrat Saeed bin Musayyib (may Allah have mercy on him) said: Li'an is an irrevocable divorce; if the one who performed li'an declares himself to be a liar, the prescribed punishment will be applied, and if he wishes, he can remarry.

Hadith Number: 1584
حدثنا خالد بن عبد الله، عن داود بن ابي هند، عن سعيد بن المسيب، قال: " الملاعن إذا كذب نفسه في مكانه جلد، وردت إليه امراته" .
Hazrat Saeed bin Musayyib (may Allah have mercy on him) said: If the one who performs li'an admits to lying at the same place, the hadd will be enforced and the wife will return to his marriage.

Hadith Number: 1585
حدثنا عتاب بن بشير، انا خصيف، عن سعيد بن جبير، قال: إذا لاعن الرجل امراته , قال:" إن اكذب نفسه وهي في العدة ضرب، وتزوجها إن شاء، وإن لم يكذب نفسه حتى تنقضي عدتها لم يتزوجها" .
Hazrat Saeed bin Jubair (may Allah have mercy on him) said: If a man performs li'an with his wife and then, during the waiting period ('iddah), admits himself to be a liar, the hadd (punishment) will be applied and marriage can take place. But if the waiting period passes, then marriage will not be permissible.

Hadith Number: 1586
حدثنا عتاب، عن خصيف، عن حماد، قال: " متى اكذب نفسه في العدة وبعد العدة تزوجها إن شاء" .
Hazrat Hammad (may Allah have mercy on him) said: Whether a man calls himself a liar during the waiting period (‘iddah) or after it, he can marry.

Hadith Number: 1587
حدثنا عتاب، عن خصيف، عن الشعبي، في الرجل يتزوج المراة وهي ببلد آخر فيقذفها ولم يرها , قال:" يجلد ولا لعان بينهما، وذكر ان الاعمى بتلك المنزلة، وكل من لا يجوز شهادته" . قال خصيف: قال حماد: " كل مخرج جعله الله للزوج فإن رآها او لم يرها فإنهما يتلاعنان , والاعمى ومن لا تجوز شهادته كذلك، والمرتد كذلك" .
Hazrat Sha'bi (may Allah have mercy on him) said: If a man marries a woman in a distant city and accuses her (of adultery) but has not seen her, then the punishment (hadd) applies to him and not li'an; the same ruling applies to a blind man and an unreliable witness. Hazrat Hammad (may Allah have mercy on him) said: Whether the man has seen the woman or not, li'an will take place; the same ruling applies to a blind man, an unreliable witness, and an apostate.
