كِتَابُ الطَّلَاقِ
Book of Divorce
بَابُ طَلَاقِ الصِّبْيَانِ وَمَا يَجِبُ فِيهِ
Chapter on the divorce by minors and its rulings
Hadith Number: 1710
نا خالد، عن مغيرة، عن إبراهيم، قال: " كانوا يكتمون الصبيان النكاح، ويكرهون ان يلقوا على افواههم الطلاق" .
Ibrahim (may Allah have mercy on him) said: "People used to conceal marriages from children and disliked uttering words of divorce over them."

Hadith Number: 1711
نا هشيم، عن مغيرة، عن إبراهيم، قال: " كانوا يكتمون الصبيان النكاح مخافة الطلاق" . قال المغيرة: وكان إبراهيم لا يهاب شيئا من الغلام إلا الطلاق.
Ibrahim (may Allah have mercy on him) said: "They used to conceal the marriage from the child, lest words of divorce be uttered." And Ibrahim (may Allah have mercy on him) only feared divorce in the case of a child.

Hadith Number: 1712
نا خالد، عن مغيرة، عن إبراهيم، قال: " الصبي لا تجوز له عطية ولا عتق حتى يحتلم، والجارية حتى تحيض. وكان لا يهاب من امر الصبي إلا الطلاق" .
Ibrahim (may Allah have mercy on him) said: "It is not permissible to give a gift or to free a slave on behalf of a child until he reaches puberty, and for a girl, menstruation is necessary." And he was only concerned about divorce in the case of a child.

Hadith Number: 1713
نا هشيم، قال: انا يونس، عن الحسن، انه كان يقول: " لا يجوز طلاق الغلام الذي لم يحتلم حتى يحتلم" .
Hasan (may Allah have mercy on him) said: "The divorce of a minor child is not valid until he reaches maturity."

نا هشيم، قال: انا ابن ابي خالد، عن الشعبي، مثل ذلك.
Hazrat Aamir Sha'bi, may Allah have mercy on him, also said the same.

نا هشيم، قال: انا بعض اصحابنا، عن سعيد بن المسيب، قال: " إذا صلي، وصام شهر رمضان، وعقل، جاز طلاقه" .
Hazrat Saeed bin Musayyib (may Allah have mercy on him) said: "When a child starts performing prayers, keeps fasts in Ramadan, and becomes sensible, then his divorce becomes valid."

نا خالد، عن صالح بن مسلم، عن الشعبي، قال: " لا يجوز طلاق الصبي" .
Hazrat Aamir Sha'bi (may Allah have mercy on him) said: "The divorce of a minor child is not valid."

Hadith Number: 1717
نا نا إسماعيل بن زكريا، عن حجاج بن ارطاة، عن عطاء، عن ابن عباس رضي الله عنه , قال: " لا يجوز صدقة الغلام، ولا هبته , ولا طلاقه، ولا عتقه" .
Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: "The charity, gift, divorce, and freeing of a slave by a minor child are not valid."

Hadith Number: 1718
نا عتاب بن بشير، قال: انا خصيف، عن مجاهد، قال: " إذا اصاب امراة حراما، فلا يصلح له ان يتزوج امها" .
Hazrat Mujahid (may Allah have mercy on him) said: "If someone establishes an unlawful relationship with a woman, then it is not permissible for him to marry that woman's mother."
