بَابُ الْحُكْمِ فِي امْرَأَةِ الْمَفْقُودِ
Chapter on the ruling regarding the wife of a missing person
Hadith Number: 1762
نا هشيم، نا إسماعيل بن ابي خالد، والشيباني، عن الشعبي، انه قال في امراة المفقود: إذا تزوجت فحملت من زوجها، ثم بلغها ان الاول حي، قال:" تعتد من هذا الاخير ببقية حملها، وإذا وضعت اعتدت من الاول اربعة اشهر وعشرا وورثته" .
Sayyiduna Sha'bi (may Allah have mercy on him) said: "If a missing woman's wife becomes pregnant by her new husband and the first husband returns alive, she will be separated from the current husband, then she will observe the waiting period ('iddah) for the first husband, and she will have a share in the inheritance."
