Book of Divorce
بَابُ الرَّجُلِ لَهُ أَرْبَعُ نِسْوَةٍ فَيُطَلِّقُ إِحْدَاهُنَّ
Chapter on a man with four wives who divorces one of them
Hadith Number: 1740
نا سفيان، عن عبد الكريم الجزري، انه سال سعيد بن المسيب , عن الرجل له اربع نسوة فطلق واحدة، قال:" لا ينكح حتى تنقضي عدة المطلقة" .
Hazrat Saeed bin Musayyib (may Allah have mercy on him) said: "If a person has four wives and he divorces one of them, then until the waiting period (‘iddah) of the divorced woman is completed, he should not marry a new wife."

Hadith Number: 1741
نا عتاب بن بشير، قال: انا خصيف، عن سعيد بن المسيب، قال: " لا يتزوج حتى تنقضي عدة التي طلق" .
Hazrat Saeed bin Musayyib (may Allah have mercy on him) said: "A divorced woman should not contract a new marriage until her waiting period ('iddah) is completed."

Hadith Number: 1742
نا ابو عوانة، عن مغيرة، عن إبراهيم، قال: " لا يتزوج الخامسة حتى تنقضي عدة التي طلق" .
Ibrahim (may Allah have mercy on him) said: "He should not marry a fifth woman until the waiting period (‘iddah) of the first divorced woman is completed."

Hadith Number: 1743
نا جرير، عن مغيرة، عن إبراهيم، في رجل له اربع نسوة فطلق إحداهن، قال:" لا يتزوج رابعة حتى تنقضي عدة التي طلق، فإن كان له اربع نسوة فماتت إحداهن، تزوج مكانها إن شاء، فليس الموت مثل الطلاق" .
Ibrahim (may Allah have mercy on him) said: "If a man has four wives and he divorces one of them, he should not marry a new wife until her waiting period ('iddah) is completed. But if a wife dies, he may marry immediately, because death is not like divorce."

Hadith Number: 1744
نا سفيان، عن ابن ابي نجيح، عن عطاء، قال: " إن كان طلقها ثلاثا فلينكح" .
Hazrat Ata (may Allah have mercy on him) said: "If divorce has been given three times, then if she wishes, she may marry."
تخریج الحدیث:
Hadith Number: 1745
نا هشيم، انا يونس، عن الحسن، انه كان يقول: " إذا طلق الرجل امراته، ثم اراد ان يتزوج اختها، فإن كان بامراته حبل لم يتزوج اختها حتى تنقضي عدتها، وإن لم يكن بها حبل تزوج اختها إن شاء" .
Hasan (may Allah have mercy on him) said: "If someone divorces his wife and she is pregnant, then he can marry her sister after the waiting period ends, and if she is not pregnant, then he can marry immediately."

Hadith Number: 1746
نا هشيم، انا مغيرة، عن إبراهيم، قال: " لا يتزوجها حتى تنقضي عدة اختها" .
Ibrahim (may Allah have mercy on him) said: "He should not marry a new sister until the waiting period (‘iddah) of the (previous) sister is completed."

Hadith Number: 1747
نا نا هشيم، انا محمد بن سالم، عن الشعبي، عن زيد بن ثابت ، انه قال: " إذا طلقها طلاقا بائنا فليتزوج اختها إن شاء في عدتها" .
Sayyiduna Zaid bin Thabit (may Allah be pleased with him) said: "If the divorce is irrevocable (bain), then during the waiting period (‘iddah) one can marry the (woman's) sister."

Hadith Number: 1748
نا هشيم، انبا يحيى بن سعيد، قال: قدم الوليد بن عبد الملك المدينة وهو يريد الحج، فاراد ان يتزوج بها، وعنده اربع نسوة، فسال عروة بن الزبير، فقال:" طلق إحدى نسائك طلاقا بائنا، ثم تزوج". ففعل ذلك .
When Al-Walid bin Abd al-Malik came to Madinah with the intention of Hajj and he had four wives with him, he consulted Urwah bin Zubair (may Allah have mercy on him). He said: "Give one of them an irrevocable divorce, then marry (another)."

Hadith Number: 1749
ثنا عبد الرحمن بن ابي الزناد، عن ابيه، قال:" كان للوليد بن عبد الملك اربع نسوة، فطلق واحدة البتة، وتزوج قبل ان تحل، فعاب ذلك عليه كثير من الفقهاء، وليس كلهم عابه" .
Some jurists objected to Al-Walid bin Abd al-Malik for not completing the waiting period before marriage, but not all objected.
