كِتَابُ الطَّلَاقِ
Book of Divorce
بَابُ مَا جَاءَ فِيمَنْ بَدَأَ بِالْيَمِينِ فِي الطَّلَاقِ وَالْعَتَاقِ قَبْلَ الِاسْتِثْنَاءِ
Chapter on those who begin with an oath in divorce and emancipation before making an exception
Hadith Number: 1814
نا ابن المبارك، عن معمر، عن ابن طاوس، عن ابيه" انه كان يرى الاستثناء في الطلاق جائزا" .
Hazrat Tawus (may Allah have mercy on him) considered exception (istithna) permissible in divorce.

Hadith Number: 1815
نا عبد الله بن المبارك، عن عبد الملك، عن عطاء، في رجل قال لغلامه: اعتقك إن شاء الله،" فلم يره عتقا" .
Hazrat Ata (may Allah have mercy on him) said: "If someone says to his slave: I will set you free, insha'Allah, then the emancipation will not take place."

Hadith Number: 1816
نا عبد الله بن المبارك، قال: انا اشعث بن حسان، قال: سالت ابا مجلز عن رجل، قال: إن دخلت دار فلان فامراته طالق ثلاثا، قلت: إلا إن شاء الله، إلا إن يشا الله، قال ابو مجلز:" اليس قد استثنى ليدخلها إن شاء" .
Hazrat Abu Majliz (may Allah have mercy on him) said: "If someone says, 'If I enter so-and-so's house, my wife is thrice divorced,' and then adds 'Insha Allah,' then he may enter."

Hadith Number: 1817
نا هشيم، قال: انا يونس، عن الحسن،" انه كان يجيز الثنيا في الطلاق، قدم الطلاق او اخره بعد ان يصل ذلك بمنطقه وكلامه" .
Hasan (may Allah have mercy on him) said: "Exception in divorce is permissible, whether the exception is mentioned before or after the divorce, as long as it is connected with the conversation."

نا هشيم، قال: انا إسماعيل بن سالم، قال: سمعت الشعبي، يقول ذلك.
Hazrat Sha'bi (may Allah have mercy on him) also said the same.

نا هشيم، قال: انا هشام، عن الحسن، انه كان يقول: " ليس في الطلاق والعتاق استثناء" .
Hasan (may Allah have mercy on him) said: "There is no exception in divorce and freeing a slave."
