Book of Divorce
بَابُ مَا جَاءَ فِي النَّصْرَانِيَّيْنِ يُسْلِمُ أَحَدُهُمَا
Chapter on what is reported regarding two Christians, one of whom accepts Islam
Hadith Number: 1974
نا نا خالد بن عبد الله، عن الشيباني، عن السفاح، عن داود بن كردوس، ان امراة من بني تميم كانت تحت رجل من بني تغلب فاسلمت، فقال عمر :" إما ان تسلم، وإما ان ننزعها عنك"، فقال: لا تحدث العرب اني اسلمت لبضع امراة، فنزعها منه .
It is narrated from Hazrat Dawood bin Kurdus, may Allah have mercy on him, that Sayyiduna Umar, may Allah be pleased with him, said: "A woman who becomes Muslim and her husband is Christian, she will be separated from him."

Hadith Number: 1975
نا نا خالد بن عبد الله، عن خالد الحذاء، عن عكرمة، عن ابن عباس ، في نصراني تحته نصرانية، فاسلمت، قال:" يفرق بينهما، لا يملك نساءنا غيرنا، نحن على الناس، والناس ليس علينا ؛ وذلك لان الله عز وجل يقول: ليظهره على الدين كله سورة التوبة آية 33" .
Sayyiduna Ibn Abbas (may Allah be pleased with them) said that if the wife of a Christian man, who is a Christian woman, accepts Islam, then separation will occur between them because Allah Almighty has said: «لِيُظْهِرَهُ عَلَى الدِّينِ كُلِّهِ» .

نا هشيم، انا يونس، ومنصور، عن الحسن، قال:" يفرق بينهما".
Hasan al-Basri, may Allah have mercy on him, says: "Separation should be made between the two."

انا إسماعيل بن إبراهيم، عن ايوب، عن ابن سيرين، قال: قال عمر :" تخير".
According to Hazrat Ibn Sirin (may Allah have mercy on him), Sayyiduna Umar (may Allah be pleased with him) said: "The woman should be given the choice."

Hadith Number: 1978
نا نا هشيم، انا مطرف، وعثمان البتي، عن الشعبي، عن علي رضي الله عنه، انه كان يقول: " هو احق بها ما لم يخرجها من دار الهجرة" .
Sayyiduna Ali (may Allah be pleased with him) used to say: "The husband has more right over his wife as long as he does not take her out of the abode of migration."

انا هشيم، انا مغيرة، عن إبراهيم، والشعبي، وإسماعيل بن ابي خالد، عن الشعبي، انهما قالا مثل ذلك.

Hadith Number: 1980
انا خالد بن عبد الله، عن مطرف، عن الشعبي، قال:" تقر عنده ؛ لان له عهدا"، قال سعيد: بئسما قال.
Hazrat Sha'bi (may Allah have mercy on him) says: "She will remain with her husband because she has a contract with him." Then Sa'id says: "This statement is not well said."

ثنا خالد، ثنا مغيرة، عن إبراهيم، والشعبي، مثله.
It is narrated from Ibrahim and Hazrat Amir Sha'bi, may Allah have mercy on them both, that both said: "This is what was said."

Hadith Number: 1982
انا انا ابو عوانة، عن حسن بن عمران، عن رجل، عن عبد الرحمن بن ابزى، ان هانئ بن قبيصة، اسلمت امراته قبله، فخشي ان يفرق بينهما، فلقي ابا سفيان بن حرب فكلمه ان يكلم له عمر، فقال ابو سفيان :" هني! ذهب الزمان الذي عهدتنا عليه، والله لو بلغني ان لي ابنا بالعراق درج على اهله طرفا ما يمنعني ان ادعيه إلا فرقا من عمر، وما يكلم في ذات الله" .
It is narrated from Hazrat Abdur Rahman bin Abzi (may Allah be pleased with him) that Hani bin Qabeesah's wife accepted Islam before him, and he feared that separation might be made between them. So he went to Sayyiduna Abu Sufyan bin Harb (may Allah be pleased with him) so that he might speak to Sayyiduna Umar (may Allah be pleased with him). Sayyiduna Abu Sufyan said: "Hani, that time has passed which we were upon. By Allah, if I even knew that I had a son in Iraq who was growing up among the people of Iraq, I would have acknowledged him as my son except for the fear of Umar. There is no intercession in the matter of Allah."

Hadith Number: 1983
نا إسماعيل بن إبراهيم، انا ابن ابي نجيح، عن مجاهد: " النصرانية تسلم تحت النصراني؟ قال:" إن اسلم زوجها وهي في العدة فهو احق بها" .
It is narrated from Hazrat Mujahid (may Allah have mercy on him), if a Christian woman becomes Muslim and her husband remains Christian, he said: "If she becomes Muslim during the waiting period ('iddah), then her husband has more right to his wife."
