كِتَابُ الطَّلَاقِ
Book of Divorce
بَابُ مَا جَاءَ فِي الْمُحِلِّ وَالْمُحَلَّلِ لَهُ
Chapter on what is reported regarding the muhill (intervening husband) and the one for whom it is done
Hadith Number: 2002
نا هشيم، انا محمد بن سالم، عن الشعبي، في رجل طلق امراته ثلاثا فتزوجت عبدا بغير إذن مواليه فدخل بها، قال:" ليس بزوج" .
It is narrated from Hazrat Sha'bi (may Allah have mercy on him) that if a woman, after being given three divorces, marries a slave without the permission of his masters and consummates the marriage, then that marriage is not valid.

نا هشيم، انا منصور، عن الحسن، انه كان يقول:" ليس بزوج". قال هشيم: وهو القول.
Hasan al-Basri (may Allah have mercy on him) used to say that such a marriage is not valid.

Hadith Number: 2004
نا هشيم، انا محمد بن سالم، عن الحكم، نا منصور، عن الحسن، في امراة طلقها زوجها ثلاثا، فتزوجت غلاما لم يحتلم فجامعها، ثم طلقها، قال:" ليس بزوج" .
It is narrated from Hasan al-Basri (may Allah have mercy on him) that if a woman marries an underage slave and consummates the marriage, that marriage will not be considered valid.

Hadith Number: 2005
نا هشيم، نا محمد بن سالم، عن الحكم بن عتيبة، انه قال:" هو زوج وتحل للاول إن شاء".
Hazrat Hakam bin Utaybah (may Allah have mercy on him) used to say that he will be the husband and the woman will become permissible for the first husband if he wishes.

Hadith Number: 2006
نا هشيم، نا محمد بن سالم، عن الشعبي، في عبد تزوج بغير إذن مولاه فطلقها قال:" لا يجوز طلاقه" .
It is narrated from Hazrat Sha'bi (may Allah have mercy on him) that if a slave marries and divorces without the permission of his master, his divorce does not take effect.

ثنا هشيم، انا منصور، عن الحسن، انه كان يقول:" لا يجوز طلاقه".
Hasan al-Basri (may Allah have mercy on him) used to say that a divorce given by a slave without permission is not valid.

نا ابو معاوية ، نا إسماعيل بن ابي خالد ، عن الشعبي ، عن الحارث ، عن علي رضي الله عنه، قال: " لعن رسول الله صلى الله عليه وسلم المحلل والمحلل له" .
It is narrated from Sayyiduna Ali (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "The curse of Allah is upon both the muhallil (the one who makes a woman lawful for her former husband by marrying and divorcing her) and the muhallal lahu (the one for whom it is done)."
