بَابُ مَا جَاءَ فِي أُمَّهَاتِ الْأَوْلَادِ
Chapter on what is reported regarding umm al-walad (mother of a child)
Hadith Number: 2066
نا هشيم، انا الشيباني، عن الشعبي، انه كان يقول: " ينتفي من ولده إذا كان من امته متى شاء" .
Hazrat Sha'bi (may Allah have mercy on him) said: "The child born from a slave woman can be denied whenever one wishes."

نا هشيم، انا ابن ابي خالد، عن الشعبي، انه قال ذلك، قال:" وإن اخذ بلحيته".
Hazrat Sha'bi (may Allah have mercy on him) said: "Even if his beard is seized, he can still deny."

Hadith Number: 2068
نا هشيم، انا مجالد، عن الشعبي، ان رجلا من كندة كان يغشى امة فحملت، فولدت على فراشه، فهنئ بالولد فاقر به، ثم اراد ان يبيع الامة بعد ذلك، فخاصمته إلى شريح، فقال لها شريح: " بينتك انك ولدت على فراشه، وانه اقر بولدك"، فاتت عليه البينة بذلك، فالحق الولد به، وقال:" لا سبيل له ان ينتفي منه" .
Hazrat Sha'bi (may Allah have mercy on him) said: "A man from the Kindah tribe had relations with his slave woman, and a child was born from her. When he wanted to sell the slave woman, she filed a case with Shurayh, and Shurayh, on the basis of testimony, attributed the child to that man and said: Now there is no way for denial."

Hadith Number: 2069
نا هشيم، انا الشيباني، عن الشعبي، عن شريح، انه كان يقول: " إذا انتفى من ولده، وهو من امة، فإن ذلك له، وإن كان من حرة تلاعن امه" .
Hazrat Shurayh (may Allah have mercy on him) said: "If a child is born from a slave woman, the master has the right to deny it, and if it is from a free woman, then li'an will be conducted with the mother."

Hadith Number: 2070
نا هشيم، انا عبيدة، عن إبراهيم، انه كان يقول: " إذا اقر بولده فليس له ان ينتفي منه، فإن انتفى منه ضرب الحد، والحق به الولد" .
Ibrahim Nakha'i (may Allah have mercy on him) said: "When someone acknowledges his child, then denial is not permissible, and if he denies, the prescribed punishment will be carried out and the child will be attributed to him."

Hadith Number: 2071
نا نا هشيم، عن ابي الزناد، عن خارجة، ان زيد بن ثابت ، كانت له جارية فارسية، وكان يعزل عنها، فجاءت بولد، فاعتق الولد وجلدها الحد، وقال:" إنما كنت استطيب نفسك ولا اريدك" .
Sayyiduna Zaid bin Thabit (may Allah be pleased with him) had a Persian slave woman. He had relations with her, but as a precaution, he practiced coitus interruptus. When she became pregnant, he imposed the prescribed punishment on her and set the child free.

Hadith Number: 2072
نا نا عبد الرحمن بن ابي الزناد، عن خارجة، قال: كان لزيد بن ثابت جارية فارسية يطؤها، وكانت تحزن له , فحملت , فقال:" ممن حملت؟" فقالت: منك، فقال:" كذبت، لقد قتلت يقينا ما وصل إليك مني ما يكون منه الحمل، وما اطؤك إلا ان استطيب نفسك ؛ لانك تحزنين لي، فلما وضعت جلدها، واعتق ولدها" .
Sayyiduna Zaid bin Thabit (may Allah be pleased with him) said: "I maintained relations with you only out of gentleness and affection, I did not intend to have children with you. When a child was born, I set him free and imposed the prescribed punishment on the slave woman."

Hadith Number: 2073
نا نا سفيان، عن ابن ابي نجيح، عن فتى من اهل المدينة، ان عمر بن الخطاب رضي الله عنه كان يعزل عن جارية له، فجاءت بحمل فشق عليه، وقال:" اللهم لا تلحق بآل عمر من ليس منهم، فإن آل عمر ليس بهم خفاء"، فولدت ولدا اسود، فقال:" ممن وضعت؟" فقالت: من راعي الإبل، فحمد الله واثنى عليه .
A slave woman of Sayyiduna Umar (may Allah be pleased with him) became pregnant. Umar (may Allah be pleased with him) prayed to Allah that no child of another man be included among the family of Umar. Later, it was found out that the child was from a camel herder. Upon this, Umar (may Allah be pleased with him) thanked Allah.
