بَابُ مَا جَاءَ فِي دُعَاءِ الْمُشْرِكِينَ عِنْدَ الْحَرْبِ
Chapter: What Has Been Reported Regarding the Supplication of the Polytheists at War
Hadith Number: 2470
نا جرير بن عبد الحميد ، عن عطاء بن السائب ، عن ابي البختري ، قال: حاصر سلمان الفارسي رضي الله عنه قصرا من قصور فارس، فقال: دعوني ادعوهم كما رايت رسول الله صلى الله عليه وسلم يدعو إني مخبركم،" اما إن شئتم فاسلموا فلكم ما للمسلمين وعليكم ما على المسلمين، فإن ابيتم فاعطوا الجزية عن يد وانتم صاغرون، فإن ابيتم فإنا ننبذ إليكم على سواء إن الله لا يحب الخائنين" ، فابوا إلا ان يقاتلوا، فوثب اصحابه ليقاتلوهم، فنهاهم حتى دعاهم ثلاثة ايام إلى اول ما دعاهم إليه، فابوا ان يجيبوه، فقاتلوا، ففتح الله على المسلمين.
Sayyiduna Salman al-Farsi (may Allah be pleased with him) while besieging a fortress said: "I invite you to Islam; if you accept, you will have the same rights and duties as the Muslims. If you refuse, then pay the jizya. If you still refuse, then we will fight you on equal terms." Then he invited them for three days; when they did not accept, he fought them and Allah granted victory to the Muslims.

Hadith Number: 2471
نا عبد الله بن وهب ، قال: اخبرني عمرو بن الحارث ، عن سعيد بن ابي هلال انه بلغه، ان رسول الله صلى الله عليه وسلم كان يقول: " لا تغلوا، ولا تغدروا، وإذا نزلت بقوم فادعهم إلى الإسلام، فإن اسلموا فادعهم إلى ان تنقلهم إلى دار الهجرة، فإن ابوا فإنهم مثل اعراب المسلمين، ليس لهم في الفيء شيء، فإن ابوا فاستعن بالله على قتالهم، وإن ارادوك على ان ينزلوا على حكم الله، فلا تفعل، فإنك لا تدري اتصيب حكم الله ام لا، ولكن ينزلوا على حكمك وحكم قومك، وإن ارادوك قوم على ان ينزلوا على انهم لهم ذمة الله فلا تفعلن، ولكن اعطهم ذمتك وذمة آبائك ؛ فإنكم إن تخفروا بذمتكم وذمة آبائكم خير لكم من ان تخفروا بذمة الله، ولا تعطين قوما عهد الله" .
It is narrated from Amr bin Harith, may Allah have mercy on him, that the Noble Prophet, peace and blessings be upon him, used to say: "Do not betray, do not deceive, when you come to a people, first invite them to Islam. If they accept Islam, then invite them to migrate to the land of Hijrah. If they refuse, then they will be like the Bedouin Muslims; they will have no share in the spoils of war. Then if they refuse, seek help from Allah and fight them. And if they say that they want judgment according to Allah's command, do not accept, because you do not know what Allah's command is. Rather, make them accept judgment according to your and your people's decision. And if they say that they want to be under Allah's protection, do not grant it, but give them your own and your forefathers' protection, because breaking your own protection is better than breaking Allah's protection. And never grant any people protection on Allah's covenant."
