كِتَابُ الشُّفْعَةِ
Book of Preemption
ذكر الخبر المصرح بأن الجار سواء كان متلاصقا أو مجاورا لا يكون له الشفعة حتى يكون شريكا لبائع الدار-
Report explicitly stating that neither adjacent nor nearby neighbors have preemption unless they are partners
Hadith Number: 5184
اخبرنا الحسين بن عبد الله القطان بالرقة، حدثنا نوح بن حبيب ، حدثنا عبد الرزاق ، اخبرنا معمر ، عن الزهري ، عن ابي سلمة بن عبد الرحمن ، عن جابر بن عبد الله : " إنما جعل رسول الله صلى الله عليه وسلم الشفعة في كل مال لم يقسم، فإذا وقعت الحدود وصرفت الطرق فلا شفعة" .
Sayyiduna Jabir bin Abdullah (may Allah be pleased with both of them) narrates: The Prophet (peace and blessings of Allah be upon him) granted the right of pre-emption (shuf‘ah) in every land that has not been divided, but when boundaries have been established and the paths have become separate, then there is no (right of) pre-emption.
