Imam Malik, may Allah have mercy on him, said: The ruling upon which there is consensus among us is that indeed, camels will not be accepted as blood money from the people of towns, and neither gold nor silver will be taken from the people of the pillars (the nomads who live in tents) (rather, only camels will be taken from them), and neither will gold be taken from those who possess silver, nor silver from those who possess gold.

Imam Malik, may Allah have mercy on him, said that if an adult and a minor together intentionally kill a person, then retribution (qisas) will be taken from the adult, and half of the blood money (diyah) will be obligatory upon the minor.

Imam Malik, may Allah have mercy on him, said that similarly, if a free person and a slave together intentionally kill a slave, then the slave will be killed in retribution, and the free person will be liable for half the value of that slave.

It is narrated from ‘Iraq bin Malik and Sulaiman bin Yasar that a man from Banu Sa‘d raced his horse and crushed the finger of a man from Juhaynah, from which blood flowed and the man died. Sayyiduna ‘Umar (may Allah be pleased with him) first said to the tribe of the one who crushed the finger:“Will you swear fifty oaths that the man did not die from the crushing of the finger?”They refused and held back. Then he said to the people of the deceased:“Will you swear an oath?”They also refused. He (may Allah be pleased with him) made half the blood money be paid by Banu Sa‘d.

Imam Malik (may Allah have mercy on him) said: This hadith is not acted upon.
