Narrated Al-Miswar bin Makhrama and Marwan: When the delegates of the tribe of Hawazin came to the Prophet he stood up amongst the people, Glorified and Praised Allah as He deserved, and said, "Then after: Your brethren have come to you with repentance and I see it logical to return to them their captives; so whoever amongst you likes to do that as a favor, then he can do it, and whoever of you like to stick to his share till we give him his right from the very first Fai (war booty) (1) which Allah will bestow on us, then (he can do so)." The people replied, "We do that (to return the captives) willingly as a favor for your sake."

And if he gives something as a gift to some of his sons, then until he gives equally to all his sons with justice, this gift will not be valid, and it is also not correct to bear witness to such an unjust gift. The Prophet (peace and blessings of Allah be upon him) said: "Do justice among your children in gifts." And can a father take back his gift? And a father can take from his son's wealth according to custom, provided he does not intend injustice. The Prophet (peace and blessings of Allah be upon him) bought a camel from Umar (may Allah be pleased with him), and then he (peace and blessings of Allah be upon him) gave it to Abdullah bin Umar (may Allah be pleased with them both) and said: "Do with it as you wish."

Narrated An-Nu`man bin Bashir: that his father took him to Allah's Apostle and said, "I have given this son of mine a slave." The Prophet asked, "Have you given all your sons the like?" He replied in the negative. The Prophet said, "Take back your gift then."

Narrated 'Amir: I heard An-Nu`man bin Bashir on the pulpit saying, "My father gave me a gift but `Amra bint Rawaha (my mother) said that she would not agree to it unless he made Allah's Apostle as a witness to it. So, my father went to Allah's Apostle and said, 'I have given a gift to my son from `Amra bint Rawaha, but she ordered me to make you as a witness to it, O Allah's Apostle!' Allah's Apostle asked, 'Have you given (the like of it) to everyone of your sons?' He replied in the negative. Allah's Apostle said, 'Be afraid of Allah, and be just to your children.' My father then returned and took back his gift."

Ibrahim Nakha'i said that it is permissible. Umar bin Abdul Aziz said that both cannot take back their gift. The Prophet (peace be upon him) sought permission from his other wives to spend his days of illness in the house of Aisha (may Allah be pleased with her), (and the pure wives gave up their turns as a gift), and the Prophet (peace be upon him) said that the one who takes back his gift is like a dog that licks its own vomit. Zuhri, regarding the person who said to his wife to gift him some or all of her dower (and she did so), and shortly after he divorced his wife and the wife demanded her (gifted dower) back, Zuhri said that if the husband did so merely to deceive, then he must return the dower. But if the wife gifted the dower of her own free will, and the husband did not deceive her in any way in this matter, then this situation is permissible. Allah Almighty says «فإن طبن لكم عن شىء منه نفسا‏» "If they (your wives) willingly give up to you something of it (their dower), then you may take it."

Narrated Az-Zuhri: Ubaidullah bin `Abdullah told me that `Aisha had said, "When the Prophet became sick and his condition became serious, he requested his wives to allow him to be treated in my house, and they allowed him. He came out leaning on two men while his feet were dragging on the ground. He was walking between Al-`Abbas and another man." 'Ubaidullah said, "When I informed Ibn `Abbas of what `Aisha had said, he asked me whether I knew who was the second man whom `Aisha had not named. I replied in the negative. He said, 'He was `Ali bin Abi Talib."

If a slave-girl is freed and at the time of the gift her husband is present, then this gift is permissible, but the condition is that the woman should not be of unsound mind. Because if she is of unsound mind, then it will not be permissible. The statement of Allah, the Exalted, is: «ولا تؤتوا السفهاء أموالكم‏» "Do not give your property to the foolish."
