Ruling If a Man Gives His Wife Authority and She Chooses Herself

١٩٠٧٩ - حدثنا ابو بكر قال: نا حفص بن غياث عن الشيباني عن الشعبي قال: قال عبد الله: إذا خير الرجل امراته فاختارت نفسها (فواحدة) (١) بائنة، وإن اختارت زوجها [فلا شيء (٢).
ريفرينس و تحكيم الحدیث:
(١) في [ط]: (لواحدة).
(٢) منقطع؛ الشعبي عن ابن مسعود منقطع.
حدثنا ابو بكر، قال: نا حدثنا ابو بكر، قال: نا حفص بن غياث، عن الشيباني، عن الشعبي، قال: قال عبد الله : " إذا خير الرجل امراته فاختارت نفسها ؛ فواحدة بائنة , وإن اختارت زوجها ؛ فلا شيء"
Hazrat Abdullah (may Allah be pleased with him) says that if a person gives his wife the right of choice and she chooses herself, then one irrevocable divorce will take place. And if she chooses her husband, then nothing will happen. Hazrat Ali (may Allah be pleased with him) says that if she chooses herself, then one irrevocable divorce will take place, and if she chooses her husband, then also one divorce will take place, and the man will have more right to take her back.
