Yunus bin Yazid reports that I asked Zuhri about the inheritance of a person whose survivors include a grandfather and full siblings. Zuhri said: Sa'id bin al-Musayyib, 'Ubaydullah bin 'Abdullah, and Qabisah bin Dhu'ayb have narrated that Sayyiduna 'Umar (may Allah be pleased with him) gave this ruling: the grandfather will share with the full siblings and the siblings from the father's side, provided that taking a share from one-third of the estate is better for him. If the number of siblings is large, then the grandfather will be given one-third, and the rest will be distributed among all the siblings, with the share of one male being equal to that of two females. He also ruled that full siblings have more right than siblings from the father's side, whether they are male or female. However, if siblings from the father's side are present along with full siblings, then they will also receive their share. But siblings from the father's side do not receive anything along with full siblings, except in the case where a brother from the father's side returns (the inheritance) to the full sisters, and after the fixed shares of the full sisters, if anything remains, it will be given to the brothers from the father's side according to the principle that one male receives the share of two females.
