باب النهي عن قتل الاسير ما لم يحتلم أو ينت، وعن قتل آسير غيره، وعن التفريق بين الوالدة وولدها، وعن وطيء الحبالي من الأسرى، وعن قتل الآسير صبرا
Chapter on the Prohibition of Killing a Captive Who Has Not Reached Puberty or Is Not Fit for Execution, Killing Other Captives, Separating Mother and Child, Intercourse with Pregnant Captive Women, and Killing a Captive by Torture
Hadith Number: 5109
عن عبيد بن تعلى قال غزونا مع عبد الرحمن بن خالد بن الوليد فاتي باربعة اعلاج من العدو فامر بهم فقتلوا صبرا بالنبل فبلغ ذلك ابا ايوب رضي الله عنه فقال سمعت رسول الله صلى الله عليه وآله وسلم ينهى عن قتل الصبر
It is narrated from Ubaid bin Ta'li, he says: We fought a battle under the leadership of Abdur Rahman bin Khalid bin Walid. Four disbelievers from among the non-Arabs were brought to him, and he ordered regarding them, so they were tied up and killed with arrows. When this reached Sayyiduna Abu Ayyub (may Allah be pleased with him), he said: I heard the Messenger of Allah (peace and blessings be upon him) forbidding killing by tying up.
تخریج الحدیث: «المرفوع منه صحيح لغيره، وھذا اسناد ضعيف،فان فيه علي الصواب بين بكير بن عبد الله وبين ابن تِعلي والدَ بكير عبدَ الله بن الاشج وھو مجھول، أخرجه أبوداود: 2687، (انظر مسند أحمد ترقيم الرسالة: 23590 ترقیم بيت الأفكار الدولية: 23988»
حكم: المرفوع منه صحيح لغيره
