Those Scholars Who Say That a Man Who Is Away Must Still Provide for His Wife; If Not, He Should Divorce Her

٢٠١٣٥ - حدثنا ابو بكر قال: نا عبد الله بن نمير قال: (نا) (١) (عبيد الله) (٢) بن عمر (عن نافع) (٣) (عن ابن عمر) (٤) قال: كتب عمر إلى امراء الاجناد فيمن غاب عن نسائه من اهل المدينة (فامرهم) (٥) ان يرجعوا إلى نسائهم، إما ان يفارقوا (و) (٦) إما ان يبعثوا بالنفقة، فمن فارق منهم فليبعث بنفقة ما ترك (٧).

Hazrat Nafi’ (may Allah have mercy on him) narrates that Hazrat Umar (may Allah be pleased with him) wrote orders to the commanders of the armies sent to various regions that those who are away from their wives should be instructed to return to their wives. Either they should return to them or send them maintenance. Whoever wishes to leave his wife should also send the maintenance that he has not sent until now.

٢٠١٣٦ - حدثنا ابو بكر قال: نا وكيع عن ابي (مكين) (١) قال: كتب عمر بن عبد العزيز: من غاب عن امراته سنتين فليطلق او (ليقفل) (٢) إليها.

Hazrat Umar bin Abdul Aziz, may Allah have mercy on him, wrote this letter to his governors: Whoever has been away from his wife for two years should either divorce her or send her maintenance.

٢٠١٣٧ - [حدثنا ابو بكر قال: حدثنا وكيع عن ابي (مكين) (١) عن عكرمة قال: من غاب عن امراته سنتين فليطلقها، او (ليقفل) (٢) إليها] (٣).

Hazrat Ikrimah (may Allah have mercy on him) says that whoever has been away from his wife for two years should either divorce her or send her maintenance.

٢٠١٣٨ - حدثنا ابو بكر قال: نا ابن إدريس عن اشعث عن الشعبي قال: إذا (طالت) (١) (غيبة) (٢) الرجل عن امراته انفق على امراته او طلقها.

Hazrat Sha'bi (may Allah have mercy on him) says that when a man has been away from his wife for a long time, he should either provide maintenance to his wife or divorce her.

٢٠١٣٩ - حدثنا ابو بكر قال: نا ابن إدريس عن ابيه عن الحكم انه كان لا يرى على الغائب نفقة.
According to Hazrat Hakam (may Allah have mercy on him), maintenance is not obligatory upon a person who is away from his wife.

٢٠١٤٠ - حدثنا ابو بكر قال: نا اسباط بن محمد عن مطرف عن الشعبي قال: إذا طالت غيبة الرجل عن امراته فليرسل إليها نفقة او ليطلقها.
Hazrat Sha'bi (may Allah have mercy on him) says that if a person has been away from his wife for a long time, he should either send her maintenance or divorce her.
