If a Man Swears to Divorce His Wife If He Does Not Beat His Slave or Marries Another Woman, but Dies Before Doing So, What Is the Ruling?

٢٠١٨٧ - حدثنا ابو بكر قال: نا هشيم (بن بشير) (١) عن منصور عن الحسن في رجل قال لامراته: هي طالق إن لم يتزوج عليها، قال: هي امراته حتى يتزوج، فإن مات واحد منهما فلا ميراث بينهما.

(١) سقط من: [س]، وفي [هـ]: (عن أبي بشر)، وفي [أ، ب، جـ]: (عن بشر)، وفي [ز]: (عن بشير).
Hazrat Hasan (may Allah be pleased with him) says that if a person says to his wife that if he does not marry another woman while she is with him, then she is divorced. In this case, if he marries, divorce will not take place. If either of them dies, they will not inherit from each other.

٢٠١٨٨ - حدثنا ابو بكر قال: نا عبد الرحيم بن سليمان عن اشعث عن الشعبي في رجل حلف: (١) امراته طالق إن لم يضرب غلامه مائة سوط، قال: هي امراته حتى يموت الغلام.

(١) في [ب]: زيادة (أن).
Hazrat Sha'bi (may Allah have mercy on him) says that if a man swears an oath that if he does not flog his slave with a hundred lashes, his wife will be divorced. In such a case, his wife will remain his wife until the slave dies.

٢٠١٨٩ - حدثنا ابو بكر قال: نا وكيع عن سفيان عن غيلان عن الحكم قال: امراته طالق إن لم يضرب غلامه، (فابق) (١)، قال: يجامعها (و) (٢) يتوارثان.

Hazrat Hakam (may Allah have mercy on him) says that if a person says to his wife that if she does not beat his slave, then she is divorced. Then his slave ran away. Both of them (the husband and wife) can have intercourse and will also inherit from each other.

٢٠١٩٠ - حدثنا ابو بكر قال: نا جرير عن [مغيرة عن حماد في رجل قال: إن لم (آت) (١) البصرة فامراته طالق، قال: فلم ياتها حتى ماتت ثم اتاها بعد، قال: لا ميراث له منها، إنما استبان (حنثه) (٢) الآن.

Hazrat Hammad (may Allah have mercy on him) says that if a man swore an oath that if he did not go to Basra, his wife would be divorced, and then he did not go to Basra until his wife passed away, and after her death he went to Basra, then in this case the woman will not receive inheritance and the breaking of the man's oath will now be considered to have occurred.

٢٠١٩١ - حدثنا ابو بكر قال: نا جرير] (١) عن مغيرة عن الشعبي قال: إن (اتى البصرة) (٢) بعد الموت ورثها.

Hazrat Sha'bi (may Allah have mercy on him) says that in the mentioned situation, if he went to Basra after her death, then he will be the heir of that woman.

٢٠١٩٢ - حدثنا ابو بكر قال: نا محمد بن يزيد عن ابي العلاء عن قتادة عن سعيد بن المسيب والحسن قالا في الرجل يقول لامراته: إن لم اتزوج عليها، وإن لم اخرجك فانت طالق، (قالا) (١): (لا يقربها) (٢)، وإن (ماتا) (٣) قبل ذلك لم يتوارثا.

(٣) في [خ، ع]: (مات).
Hazrat Saeed bin Musayyib (may Allah have mercy on him) and Hazrat Hasan (may Allah be pleased with him) say that if a man says to his wife, "If I do not marry someone else over you or if I do not divorce you, then you are divorced," in this case, the man cannot go near his wife, and if so, neither of them will be heirs to each other.

٢٠١٩٣ - حدثنا ابو بكر قال: نا معاذ بن (معاذ) (١) عن اشعث عن (الحكم) (٢) في رجل قال: إن لم اخرج إلى واسط فامراته طالق، قال: يغشاها ولا يتوارثان.

(١) في [س]: (معاد)، وفي [أ]: (معاد بن معاز).
(٢) في [خ، ع]: (الحسن).
Hazrat Hasan (may Allah be pleased with him) says that if a person said to his wife that if I do not go towards Wasit, then his wife will be divorced. In this case, the man will have intercourse with his wife and neither of them will inherit from each other. And Hazrat Ibn Sirin says that he should not have intercourse with her until he does what he has said.
