If a Man Divorces His Wife Three Times While Terminally Ill and Then Dies, Is the Widow's Waiting Period Obligatory?

٢٠١٩٥ - حدثنا ابو بكر قال: نا جرير عن مغيرة عن إبراهيم قال: قال شريح: اتاني عروة (البارقي) (١) من عند عمر في الطلق ثلاثا في مرضه: (ترثه) (٢) ما دامت ⦗٤٤٦⦘ في العدة، (و) (٣) لا يرثها، وعليها عدة المتوفى عنها زوجها (٤).
ريفرينس و تحكيم الحدیث:
(١) في [س]: (الباقي).
(٢) سقط من: [أ، ب، س، هـ].
(٣) سقط من: [هـ].
(٤) صحيح.
Hazrat Shurayh (may Allah have mercy on him) says that Hazrat Urwah Barqi brought a message to me from Hazrat Umar (may Allah be pleased with him) stating that if a person gives his wife three divorces during his terminal illness, then the woman will inherit from him, while he will not inherit from the woman. And the woman will have to observe the waiting period (‘iddah) of a woman whose husband has passed away.

٢٠١٩٦ - [حدثنا ابو بكر قال: نا جرير عن مغيرة عن إبراهيم قال: عليها عدة المتوفى عنها زوجها] (١).
ريفرينس و تحكيم الحدیث:
(١) سقط الخبر من: [أ، ب، جـ، س، هـ]، وتأخر الخبر في: [ط، ك] لما بعد الخبر الآتي.
Ibrahim (may Allah have mercy on him) said that a woman must observe the waiting period (‘iddah) prescribed for a woman whose husband has passed away.

٢٠١٩٧ - حدثنا ابو بكر قال: نا عبد الاعلى عن هشام عن الحسن ومحمد قالا: إن مات الرجل في عدتها اعتدت عدة المتوفى عنها زوجها: اربعة اشهر وعشرا.
Hazrat Hasan (may Allah be pleased with him) and Muhammad (may Allah have mercy on him) say that if a man passes away during a woman's waiting period ('iddah), she will observe a waiting period of four months and ten days.

٢٠١٩٨ - حدثنا ابو بكر قال: نا وكيع عن زكريا عن الشعبي قال: باب من الطلاق جسيم: إذا ورثت اعتدت.
Hazrat Sha'bi (may Allah have mercy on him) says that this is a very lengthy chapter of divorce; when she becomes an heir, she will also observe the waiting period ('iddah).

٢٠١٩٩ - حدثنا ابو بكر قال: نا ابو داود عن حبيب عن عمرو عن عكرمة انه قال: لو لم يبق من عدتها إلا يوم واحد ثم مات؛ ورثته واستانفت عدة المتوفى عنها.
Hazrat Ikrimah (may Allah have mercy on him) says that if only one day of the waiting period (iddah) remains and the husband dies, then the woman will become an heir and she will observe a new waiting period (iddah) from the beginning, whose husband has passed away.

٢٠٢٠٠ - حدثنا ابو بكر قال: نا ابو داود عن شيبان عن جابر عن عامر عن شريح قال: تستانف العدة.
Hazrat Aamir (may Allah have mercy on him) says that she will observe the waiting period (iddah) anew.
