If a Man Has Relations with a Slave Girl After Purchase, Then Discovers a Defect

٢٢١٥٤ - حدثنا ابو بكر قال: حدثنا (شريك) (١) عن جابر عن عامر (عن) (٢) عمر (٣) قال: إن كانت ثيبا رد نصف العشر، وإن كانت بكرا رد (٤) العشر (٥).

(٤) في [ز]: زيادة (نصف).
(٥) ضعيف منقطع؛ جابر ضعيف، وعامر لا يروي عن عمر.
Hazrat Umar (may Allah be pleased with him) said that if the slave woman was previously married, then one should take back one-twentieth; and if she was a virgin, then one should take back one-tenth.

٢٢١٥٦ - حدثنا ابو بكر قال: حدثنا حفص عن جعفر عن ابيه عن (علي) (١) ابن الحسين عن علي قال: لا يردها، و (لكنها) (٢) (تكسر) (٣) فيرد (٤) عليه قيمة (العيب) (٥) (٦).

(٦) منقطع؛ علي بن الحسين لم يسمع من علي.
Hazrat Ali (may Allah be pleased with him) said that the slave-girl will not be returned, but the price of the defect will be refunded to him.

٢٢١٥٧ - حدثنا ابو بكر قال: حدثنا عبد الاعلى عن يونس عن الحسن قال: إذا اشترى الرجل الجارية ثم ظهر بها داء كان عند البائع، قال: كان يوجبها عليه، ولا يرد عليه البائع شيئا.
Hasan (may Allah have mercy on him) said that when a person buys a slave-girl and then a disease (defect) appears in her which existed while she was with the seller, then it is the responsibility of the seller; the seller will not take anything back from him.

٢٢١٥٨ - حدثنا ابو بكر قال: حدثنا عبد الاعلى عن معمر عن الزهري عن عمر ابن عبد العزيز انه امضاها عليه، ولم يرد عليه شيئا.
Hazrat Umar bin Abdul Aziz (may Allah have mercy on him) said that the sale will be enforced upon him, and nothing will be returned to him.

٢٢١٥٩ - حدثنا ابو بكر قال: حدثنا عبد الوهاب عن ايوب عن محمد في الرجل يشتري الجارية وبها داء فيقع عليها قبل ان يطلع على ذلك، قال: احب إلي ان يوضع عنه بقدر ذلك، ويجوز عليه.
Muhammad, may Allah have mercy on him, says regarding a person who buys a slave girl who has a disease, and he has intercourse with her before becoming aware of the defect, that he says: I prefer that her price be reduced somewhat, and this sale will be permissible for him.

٢٢١٦٠ - حدثنا ابو بكر قال: حدثنا علي بن مسهر عن الشيباني عن الشعبي عن شريح قال: ما كان يوقت (فيها) (١) شيئا، يقضي على نحو ما يرى من (هيئتها) (٢).

Hazrat Shurayh (may Allah have mercy on him) says that in the case of a slave-girl, the option of time (for choice) will not be given; rather, the buyer will decide based on the apparent condition.

٢٢١٦١ - حدثنا ابو بكر قال: حدثنا ابن علية عن ايوب عن ابي معشر عن إبراهيم قال: إن كانت بكرا رد العشر، وإن كانت ثيبا رد نصف العشر.
Ibrahim (may Allah have mercy on him) said that if she was a virgin, then one-tenth of the dowry will be returned, and if she was previously married, then half of one-tenth will be returned.

٢٢١٦٢ - حدثنا ابو بكر قال: حدثنا عبد الاعلى عن معمر عن الزهري عن سعيد بن المسيب قال: يرد معها عشرة دنانير.
Hazrat Saeed bin Al-Musayyib (may Allah have mercy on him) says that he will also return ten dinars along with the slave-girl.
