Testimony of Children

٢٢٣٣٠ - حدثنا ابو بكر قال: حدثنا ابن علية عن ابن عون عن ابن سيرين انه قال في شهادة الصبيان: تكتب شهادتهم و (يستثبتون) (١).

Hazrat Ibn Sirin, regarding the testimony of children, states that their testimony will be recorded and its verification and investigation will be carried out.

٢٢٣٣١ - حدثنا ابو بكر قال: حدثنا معاذ بن معاذ عن اشعث عن محمد (عن حميد) (١) بن عبد الرحمن قال: يستثبتون.

Hazrat Humaid bin Abdur Rahman, may Allah have mercy on him, says that investigation will be conducted.

٢٢٣٣٢ - حدثنا ابو بكر قال: حدثنا ابن ابي زائدة عن حجاج عن عطاء عن ابن عباس قال: لا تجوز شهادة الصبي (١).

(١) منقطع حكمًا؛ حجاج مدلس.
Hazrat Ibn Abbas (may Allah be pleased with them) states that the testimony of children is not valid.

٢٢٣٣٣ - حدثنا ابو بكر قال: حدثنا ابن ابي زائدة (عن) (١) عبد الملك عن عطاء قال: لا تجوز شهادة الصغار حتى يكبروا.

Hazrat Ata (may Allah have mercy on him) says that the testimony of children is not valid before they reach maturity.

٢٢٣٣٤ - حدثنا ابو بكر قال: حدثنا ابن ابي زائدة عن ابي سهل عن عامر قال: كان لا (يجيز) (١) شهادة (الصبي) (٢).

Hazrat Aamir (may Allah have mercy on him) did not consider the testimony of children to be permissible.

٢٢٣٣٥ - حدثنا ابو بكر قال: حدثنا وكيع قال: حدثنا سفيان عن (الزبير) (١) ابن عدي عن سليمان الهمداني، قال: شهدت عند شريح وانا غلام فقال: بإصبعه في بعض جسدي: حتى تبلغ.

Sulaiman al-Hamdani, may Allah have mercy on him, says that when I was young, I gave testimony before Hazrat Shurayh, may Allah have mercy on him. He, may Allah have mercy on him, touched some part of my body with his finger and said: Testimony is not valid before reaching puberty.

٢٢٣٣٦ - حدثنا ابو بكر قال: حدثنا وكيع قال: (شهد) (١) عند ابن ابي ليلى (صبيان) (٢) من الحي لم يبلغوا، فقال: اكتب: شهد فلان وفلان وهم صغار ولم يبلغوا، فإذا بلغوا فإن ثبتوا على شهادتهم جازت، وإن رجعوا فليس بشيء.

(١) في [أ، ح، هـ]: (شهدت)، وفي [ط]: (شهادات).
(٢) في [ح، هـ]: (صبيانًا).
Hazrat Waki’ (may Allah have mercy on him) says that some children from the neighborhood, who were not yet of age, testified before Hazrat Ibn Abi Layla (may Allah have mercy on him). He (may Allah have mercy on him) said: Write down the testimony of so-and-so and so-and-so. When they reach maturity, see if they remain firm upon it; if so, the testimony is valid. But if they retract, then that testimony will be nullified.

٢٢٣٣٧ - حدثنا ابو بكر قال: حدثنا وكيع قال: حدثنا إسرائيل عن عيسى بن ابي عزة عن الشعبي انه كان يجيز شهادة الصبيان ويرسل إليهم فيسالهم عنها.
Hazrat Sha'bi (may Allah have mercy on him) considered the testimony of children to be valid.

٢٢٣٣٨ - حدثنا ابو بكر قال: حدثنا وكيع قال: حدثنا سفيان عن ابي إسحاق عن شريح انه اجاز شهادة غلمان في آمة (١)، وقضى فيها باربعة آلاف.

(١) الآمة: شجة في الرأس تصل لأم الدماغ.
Hazrat Shurayh (may Allah have mercy on him) accepted the testimony of a child in the matter of a slave girl and issued a verdict of four thousand dirhams.

٢٢٣٣٩ - حدثنا ابو بكر قال: حدثنا يحيى بن سعيد القطان عن عمرو عن الحسن عن علي انه كان يجيز شهادة الصبيان بعضهم على بعض (١).

(١) منقطع؛ الحسن لا يروي عن علي.
Hazrat Ali (may Allah be pleased with him) considered the testimony of children about children to be permissible.
