٢٢٥٠٦ - حدثنا ابو بكر قال: حدثنا ابن علية عن ايوب عن (ابي) (١) الزبير عن جابر ان النبي ﷺ نهى عن (الثنيا) (٢) (٣).

(٣) صحيح؛ أخرجه مسلم (١٥٣٦)، وأحمد (١٤٣٥٨).
It is narrated from Hazrat Jabir (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) forbade making a sale in which a certain (unknown) portion is separated.

٢٢٥٠٧ - حدثنا ابو بكر قال: حدثنا ابن علية عن ايوب عن عمرو بن شعيب قال: قلت لسعيد بن المسيب: ابيع (ثمرة) (١) ارضي واستثني؟ قال: لا تستثن إلا شجرا معلوما، ولا تبران من الصدقة.

Hazrat Amr bin Shu'aib narrates that I asked Hazrat Sa'id bin al-Musayyib (may Allah have mercy on him): Can I sell the fruits of my land and separate some portion from it? He replied: Do not make an exception; if you must, then separate a specific tree, but do not exempt it from charity either. The narrator says that I mentioned this to Hazrat Muhammad bin Sirin (may Allah have mercy on him), and he approved of this opinion.

22508 - He said: I mentioned it to Muhammad ibn Sirin, and it seemed to please him.

٢٢٥٠٩ - حدثنا ابو بكر قال: حدثنا إسماعيل بن علية وابن ابي زائدة عن ابن عون عن القاسم، قال: لولا ان ابن عمر كره (الثنيا) (١) وكان عندنا مرضيا (٢) ما راينا بذلك باسا (٣).

(٢) في [ط]: زيادة (قال).
(٣) صحيح.
Hazrat Qasim (may Allah have mercy on him) says that if Hazrat Ibn Umar (may Allah be pleased with both of them) did not dislike separating some unspecified portion, and if it were up to our own choice, then we would not see any harm in it. Ibn 'Alyah, the narrator, adds that Hazrat Ibn Umar (may Allah be pleased with both of them) used to say: I will not sell this particular tree, I will not sell this particular tree.

٢٢٥١٠ - زاد ابن علية عن ابن عون فتحدثنا ان ابن عمر كان يقول: لا ابيع هذه النخلة، ولا (ابيع) (١) هذه النخلة (٢).

(٢) منقطع؛ ابن عون لم يدرك ابن عمر.
22510 - Ibn ‘Ulayyah added from Ibn ‘Awn: So we were told that Ibn ‘Umar used to say: I will not sell this palm tree, nor (will I sell) (1) this palm tree (2).

٢٢٥١١ - حدثنا ابو بكر قال: حدثنا عباد عن يحيى بن سعيد عن سعيد بن المسيب انه كره ان (يشتري شيئا من النخل) (١) بكيل.

Hazrat Saeed bin Al-Musayyib (may Allah have mercy on him) disliked that some of the date trees be bought by measuring their produce.

٢٢٥١٢ - حدثنا ابو بكر قال: حدثنا ابو الاحوص عن (ابي حمزة) (١) قال: قلت لإبراهيم: (ابيع) (٢) الرجل الشاة و (استثني) (٣) بعضها، قال: لا، ولكن (قل) (٤): ابيعك نصفها.

(٣) في [أ، ح، هـ]: (يستثني).
(٤) في [هـ]: (يقول)، وفي [أ، ح]: (قال).
Hazrat Abu Hamza, may Allah have mercy on him, says that I asked Ibrahim, "I sold a goat to a man and excluded a part of it; is this permissible?" He replied, "It is not correct. Rather, you should say to him, 'I sell you half of the goat.'"

٢٢٥١٣ - حدثنا ابو بكر قال: حدثنا عبد الصمد (عن) (١) ابي الجارود قال: سالت جابر بن زيد عن الرجل يبيع البيع ويستثني بعضه، قال: لا يصلح ذلك.

It was asked from Hazrat Jabir (may Allah be pleased with him) that a person sells something and exempts a part of it? He replied: This is not correct.

٢٢٥١٤ - حدثنا ابو بكر قال: حدثنا عبد الاعلى عن يونس عن الحسن في الرجل يبيع ثمر ارضه ويستثني الكر، قال: كان يعجبه ان يعلم نخلا.
It was asked from Hasan (may Allah have mercy on him) whether a man sells dates from his land and exempts one (or some) kurr, he replied: It is astonishing that he knows the date palm tree (as to how many dates it will yield).

٢٢٥١٥ - حدثنا ابو بكر قال: حدثنا ابن مهدي عن حماد بن سلمة عن حجاج قال: سالت ابا بكر بن ابي موسى عن رجل باع من رجل سلعة وقال: انا (شريكك) (١) فيها قال: فكره هذا البيع.

Hazrat Hajjaj says that I asked Hazrat Abu Bakr bin Abu Musa, may Allah have mercy on him, that a man sold goods to another and he said, "I am your partner in the goods?" He disliked this sale.
