Hiring a Slave from Someone

٢٢٧٢٨ - حدثنا ابو بكر قال: حدثنا عبد الاعلى عن هشام عن الحسن في رجل آجر غلامه سنة ثم اراد ان يبيعه قال: يبيعه إن شاء.
Hasan (may Allah have mercy on him) said regarding the person who gives his slave on hire for a year, then during the year intends to sell that slave, he said: If he wishes, he can sell him.

٢٢٧٢٩ - حدثنا ابو بكر قال: حدثنا عبد الوهاب الثقفي عن خالد (عن إياس) (١) ابن معاوية في الغلام يدفعه الرجل إلى الرجل يعلمه ثم يخرجه قبل ان (ينقضي) (٢) شرطه، قال: يرد على معلمه ما انفق عليه.

Hazrat Iyas bin Mu'awiyah says regarding the person who sends his slave to another person so that he may teach him, then before the condition is fulfilled he takes him away from there, then whatever the teacher has spent on this slave shall be returned to him.

٢٢٧٣٠ - حدثنا ابو بكر قال: حدثنا غندر عن شعبة عن الحكم قال: سالته عن رجل اجر غلامه سنة (واراد ان) (١) يخرجه، قال: له ان ياخذه.

A person asked Hazrat Hakam that a man has given his slave on hire for a year, then he intends to take him back from the hirer, so what is the ruling on this? He (may Allah have mercy on him) replied that he is not permitted to take him back (to take him from the hirer). Then I asked Hazrat Hammad about this matter. He (may Allah have mercy on him) replied that he should not take him back except to avoid loss.

22731 - He said: And I asked Hammad, and he said: He should not take it except from (Mudarra) (1).

٢٢٧٣٢ - حدثنا ابو بكر قال: حدثنا شبابة عن شعبة عن الحسن بن (عبيد الله) (١) قال: سمعت ابا (الضحى) (٢) يذكر ان شريحا ومسروقا كانا يقولان في الرجل إذا آجر العبد سنة او شهرا او نحو ذلك ثم بدا له ان ياخذه منه فذلك له.

(١) في [أ، جـ، ح، ز، ط]: (عبد اللَّه).
(٢) [أ، ح، ط]: (الضحاك).
Hazrat Shurayh (may Allah have mercy on him) and Hazrat Masruq (may Allah have mercy on him) say that if a person gives his slave on rent for a year, or for a month, or for some period, then if he intends to take the slave back from him, he can take him back.
