If a Mukatab Dies Owing Both Mukatabah Payments and Debt

٢٢٧٦٨ - حدثنا ابو بكر قال: حدثنا حفص عن الشيباني واشعث وإسماعيل عن الشعبي عن شريح في مكاتب مات وعليه دين وبقية من مكاتبته قال: يضرب مواليه بما حل من (نجومه) (١).

Hazrat Shurayh (may Allah have mercy on him) says regarding the mukatab who dies in such a state that he has debt and the his installments for manumission is also remaining, then the obligatory his installments for manumission will be paid before the debt.

٢٢٧٧٠ - حدثنا ابو بكر قال: حدثنا حفص عن سعيد عن قتادة عن سعيد بن المسيب قال: اخطا شريح وإن كان قاضيا، كان زيد بن ثابت يقول: (يبدا) (١) بالدين قبل المكاتبة (٢).

Hazrat Saeed bin Al-Musayyib (may Allah have mercy on him) says that although Hazrat Shurayh (may Allah have mercy on him) was a judge, he made a mistake. Hazrat Zaid bin Thabit (may Allah be pleased with him) used to say that the debt will be paid before the contract of Mukatabah.

٢٢٧٧١ - حدثنا ابو بكر قال: حدثنا جرير عن منصور عن إبراهيم قال: إذا مات المكاتب وعليه دين يضرب مواليه بما حل من نجومه (مع الغرماء) (١)، وإن لم يكن له نجم حال (بدئ بالغرماء) (٢) فاخذوا دينهم، فإن فضل شيء كان لمواليه حتى تتم مكاتبته، فإن فضل شيء بعد مكاتبته كان لورثته.

Ibrahim (may Allah have mercy on him) said that if a mukatab slave dies while he is in debt, then his master will be placed alongside the creditors. Whatever of the installments is due will be given first, and if no installment is immediately due, then the creditors will be given precedence, so they will recover their debt. If anything remains after that, it will go to the masters until the price of manumission is completed, and if anything remains even after the price of manumission has been paid, then it will go to his heirs.

٢٢٧٧٢ - حدثنا ابو بكر قال: حدثنا وكيع عن سفيان عن منصور عن إبراهيم قال: يضرب مولاه مع الغرماء بما حل من نجومه.
Ibrahim (may Allah have mercy on him) says that his master will be joined with the creditors for the installment that has become due from the installments.

٢٢٧٧٥ - حدثنا ابو بكر قال: حدثنا ابن فضيل عن اشعث عن الشعبي والحكم انهما قالا: إذا كان على الرجل الدين وبقية من مكاتبته، (قالا) (١): ينظر إلى ما حل عليه من نجومه وما كان لغرمائه فيقسم ذلك بالحصص.

Hazrat Sha'bi (may Allah have mercy on him) and Hazrat Hakam state that if a slave has debt and the compensation for the contract of emancipation (mukatabat) is also remaining, then the installment that has become due will be considered, and whatever portion of it belongs to his creditors will be distributed among them according to their respective shares.

٢٢٧٧٦ - حدثنا ابو بكر قال: حدثنا وكيع (ان) (١) حسن بن صالح وسفيان وابن ابي ليلى كانوا يقولون: إذا مات وعليه دين حل ما عليه، فيضرب المولى مع الغرماء بجميع المكاتبة.

Hasan, Hazrat Sufyan, and Hazrat Ibn Abi Laila (may Allah have mercy on them) state that if a slave passes away and there is still debt upon him, then whatever was upon him will become immediately due, and his master will include all the property in the contract of manumission along with the creditors.

(٢) أضاف في [هـ]: (حدثنا أبو بكر بن أبي شيبة قال: حدثنا عبد اللَّه بن إدريس عن سعيد عن قتادة عن سعيد بن المسيب عن زيد عن ثابت قال: يبدأ بالدين)، آخذًا من سنن البيهقي ١٠/ ٣٣٢.
(٣) صحيح.
