If a Slave Girl Bears a Child to Her Owner

٢٢٩٣١ - حدثنا ابو بكر قال: حدثنا عبد السلام بن (حرب) (١) عن مغيرة عن إبراهيم وعامر في الرجل يتزوج الامة فتلد منه ثم يشتريها، قالا: يبيعها ما لم تلد في ملكه.
ريفرينس و تحكيم الحدیث:
(١) في [ز]: (خرث).
Ibrahim and Hazrat Amir, may Allah have mercy on them, were asked: If a man marries a slave woman, then she bears him a child, and then he also buys her, what is the ruling regarding this? Both of them replied: He can sell her as long as she has not given birth to a child in his ownership.

Hazrat Tawus says that he can buy (sell) it.

٢٢٩٣٣ - حدثنا ابو بكر قال: حدثنا عبد السلام عن سعيد عن قتادة عن الحسن قال: هي ام ولد.
Hazrat Hasan (may Allah be pleased with him) says that she is his umm walad.

٢٢٩٣٤ - حدثنا ابو بكر قال: حدثنا وكيع عن سفيان عن حماد قال: لا يبيعها هي بمنزلة ام ولد.
Hazrat Hammad says: He should not sell her; she is his Umm-e-Walad.
